AMENDMENT NOTICE: This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, in conjunction with FAR 13.5, as applicable, and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; bids are being requested and a written solicitation will not be issued. The solicitation number is HSCEMS-10-Q-00042 and is issued as an invitation for bids (IFB), unless otherwise indicated herein. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-44. The associated North American Industrial Classification System (NAICS) code for this procurement is 541219 with a small business size standard of $8.50M. This requirement is unrestricted and only qualified offerors may submit bids. The solicitation pricing on www.FedBid.com will start on the date this solicitation is posted and will end on 2010-09-25 11:00:00.0 Eastern Time or as otherwise displayed at www.FedBid.com. FOB Destination shall be Multiple shipping information. Questions must be submitted by using the 'Submit a Question' feature at www.fedbid.com. Questions not received within a reasonable time prior to close of the solicitation may not be considered.*** For this solicitation, DHS Immigration and Customs Enforcement intends to conduct an online competitive reverse auction to be facilitated by the third-party reverse auction provider, FedBid, Inc. FedBid has developed an online, anonymous, browser based application to conduct the reverse auction. An Offeror may submit a series of pricing bids, which descend in price during the specified period of time for the aforementioned reverse auction. DHS Immigration and Customs Enforcement is taking this action in an effort to improve both vendor access and awareness of requests and the agency's ability to gather multiple, competed, real-time bids. All responsible Offerors that respond to this solicitation MUST submit the pricing portion of their bid using the online exchange located at www.FedBid.com. There is no cost to register, review procurement data or make a bid on www.FedBid.com. Offerors that are not currently registered to use www.FedBid.com should proceed to www.FedBid.com to complete their free registration. Offerors that require special considerations or assistance may contact the FedBid Helpdesk at 877-9FEDBID (877-933-3243) or via email at clientservices@fedbid.com. Offerors may not artificially manipulate the price of a transaction on www.FedBid.com by any means. It is unacceptable to place bad faith bids, to use decoys in the www.FedBid.com process or to collude with the intent or effect of hampering the competitive www.FedBid.com process. Use of FedBid: Buyers and Sellers agree to conduct this transaction through FedBid in compliance with the FedBid Terms of Use. Failure to comply with the below terms and conditions may result in offer being determined as non-responsive. The selected Offeror must comply with the following commercial item terms and conditions, which are incorporated herein by reference: FAR 52.211-6 Brand Name or Equal, FAR 52.212-1, Instructions to Offerors - Commercial Items, applies to this acquisition; FAR 52.212-3, Offeror Representations and Certifications - Commercial Items - the selected offeror must submit a completed copy of the listed representations and certifications; FAR 52.212-4, Contract Terms and Conditions - Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders-Commercial Items, paragraph (a) and the following clauses in paragraph (b): 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-37, 52.225-13, 52.232-34. Please review Statement of Work Offeror must be registered in the Central Contractor Registration (CCR) database before an award can be made to them. If the offeror is not registered in the CCR, it may do so through the CCR website at http://www.ccr.gov Company must be registered on Online Representations and Certifications Application (ORCA) before an award could be made to them. If company is not registered with ORCA, they may do so by going to ORCA web site at https://orca.bpn.gov/ Unless the Buyer indicates otherwise within a particular line item description, each Seller shall include in its online Bid individual pricing for all required line items in order to be considered for award (i.e., Do not use the Included in another line item function when pricing each line item). If a line item cannot be separately priced, you must notify the buyer through the FedBid Submit a Question feature regarding which line item(s) should be included in which other line item(s) and request reposting. Failure to comply with this term may result in the Bid being determined to be non-responsive. For all buys other than Exact Match Sellers MUST document what they are bidding for evaluation for award. Sellers must include, extended specs and/or manufacturer name and part numbers (if applicable) by the end date and time of this solicitation. Failure to do this may be cause for termination. This information is REQUIRED in order for a sellers bid to be deemed 'responsive' and to be considered for award. FAR 52.211-6 Q&A -Please submit all questions by using the 'Submit a Question' button. This buy will then be reposted with Q&A based on the questions that come in (if applicable). An award will be made to a responsive offeror (who submits all required submissions on time), whose past performance does not pose a risk to the Government, and whose offer is the Lowest Price Technically Acceptable (LPTA). An offer is technically acceptable if its technical capabilities conform to the Government's Statement of Work or listed specs whichever is applicable to the buy. For Exact Match Services Buys Only- In order for a sellers bid to be 'responsive' and considered for award, the seller is REQUIRED to document exactly how they intend to meet the requirements of the SOW. They shall document statement detailing the service for evaluation. Failure to do this may be cause for termination. This information is REQUIRED in order for a sellers bid to be deemed 'responsive' and to be considered for award. Note, the SOW contains instruction for both Texas and Vermont. Sellers are encouraged to focus on the labor categories as stated in the SOW and submit all necessary documents which include: resumes, HSAR 3052.209-72, past performance and pricing submission through FedBid. Sellers shall upload all resumes, completed HSAR 3052.209-72, past performance information by means of FedBid's electronic file upload mechanism so that it is received no later than the closing date of this solicitation. Question: One the second page of the SOW, the second paragraph of the "Scope of Work" references "Attachment A" but this was not provided. Can the government please provide Attachment A? Answer: Sellers are to upload pricing as specified on FedBid. This replaces Attachment A stated on the second page of the SOW. *Question: How many Past Performances are required for this bid? Bid line item 004 and 005 appear to be dupicates because both reference Vermont. Are both items for Vermont? Are we limited to one resume per position or should we submit additional resumes? Answer: 1) Please provide at least three past performances. 2) Vermont requirement is for two accounting technician; therefore, resumes would be needed for each individual. 3) Resumes are needed for each position and individual that would need to be considered for a specific position. Question: Is this procurement Recovery Act funded? Answer: No.*Question: Are the positions subject to the Service Contract Act? Is there a DOL Wage Determination? Answer: No, the labor categories listed in the solicitation are considered professional services and therefore, would not be applicable to the Wage Determination. **Question: The three staff for Dallas appear to be required for only 350 hours each (about 9 weeks) over the course of a 6 month window (26 weeks). How far in advance will we know when ICE will need the extra support? Answer: Typically 30 days but no less than 14 calendar days. And the estimates for Dallas for all three labor categories totals 949 hours.**Question: Item Id 4 and 5 each say 935 hours for 2 accounting technicians. Does that mean 1,870 hours for 2 accounting technicians total (which would make them full time) or 1,870 hours spread over 4 accounting technicians (in which case they are all part time)? Answer: Per Attachment A (Section B: Supplies/ServicesPrice/Cost Schedule) the 935 hours (estimated) shown is for Lead Accounting Technician labor category at the Burlington Finance Center and per answer to item #4 below, may be more than one Lead Accounting Technician based on schedule for work. The 1,870 hours (estimated) is for Accounting Technician labor category and again is subject to final work schedule per week based on actual number of positions needed during the performance period.**Question:Does the government anticipate requesting the support for a continuous amount of time (8 hours a day for 9 weeks) or piecemeal (I will need you for 4 hours on Friday and another 6 hours next Tuesday)? Answer: Subject to specific work assignments, but typically would be set number of hours each day for the full time period needed (e.g., 90 days), although not necessarily eight hours each day (e.g., six hour work schedule).***Question: The Junior Financial Analyst in Williston is requested for 1,223 hours over six months which is a 47 hour work week. The SOW however prohibits working more than 40 hours without written authorization. Please clarify. Answer: The available Junior Financial Analyst hours are a total for that labor category and per above response, could have more than one position working less than 40 hours per week (see response for item #4).***Question: Are bidders required to bid on all 7 position to be considered or can they bid on just Dallas or just Williston? Answer: Bids must include proposals/bids on all labor categories identified in the solicitation (Accounting Technician, Lead Accounting Technician, and Junior Financial Analyst), and specific labor category rate for each location (if bidding on both locations). The bidders bid on both or either location (but must include again bids for all three labor categories) but preference is given to most competitive bids that includes both locations for management/COTR oversight. ***Question: Please confirm that the government is looking for 7 hourly rates, 7 representative resumes and one past performance reference. Answer: The proposal needs to include bids for all labor categories and include representative resumes and past performance references.***Question: Does the government maintain the option of extending this contract by another 6 months? Answer: Yes subject to funding. ***Question: Is the government committed to bring on this support for these hours or is the contract to provide the government the option of bringing up to 7 people on board for up to these hours? Answer: The labor category work hours identified, for each location and in total, are a cap subject to actual work hours scheduled for the full time period needed (see answer to item #4). ***Question: One the second page of the SOW, the second paragraph of the "Scope of Work" references "Attachment A" but this was not provided. Can the government please provide Attachment A? Answer: Attachment A is Section B: Supplies/Services Prices/Cost Schedule document of Solicitation. ***Question:On attachment D, do we need to mail the past performance questionnaire to our customer to have our customer fill out and send it back to you? Or do you mail the past performance questionnaire to our customer? Also on attachment D, with regards to the past performance questionnaire, do we need to fill out the information at the top (i.e. name of proposed contractor, contract number, name of rater, phone number, contract type, place of performance, period of performance and contract dollar amount) and send it to our customer now and then send it with the package once we receive it? Or can we add our own past performance write-up and send it to you that would include the proposed contractor, contract number and phone number, contract type, place of performance, period of performance and contract dollar amount? Answer: Past performances should be provided on/or before closing of the solicitation. It is the seller decision as to who completes the form as long as all of the information requested is completed. Yes, we will look at your own past performance write up as long as it addresses the information requested in the solicitation.
