Description

1. Agency and Contracting Activity Identification: The Department of Veterans Affairs Network VISN 22 Contracting Activity (NCA), 5901 East Seventh Street, Long Beach, CA 90822, has received a requirement to purchase Motorized Patient Transport Solutions in the form of Motorized Stretchers for the VA Greater Los Angeles Healthcare System. 2. Nature of Acquisition Being Approved: Negotiation shall be conducted to procure these Motorized Patient Transport Solutions from Alliant healthcare. Circumstances require that this be done without the benefit of full and open competition. This shall be conducted as a one-time purchase contract through other than full and open market procedures. Cost: $548,978.24. 3. Description of Requirement: VA Greater Los Angeles Healthcare System requires 32 Patient Transport Solutions which have the following capabilities: 700lb weight capacity, wide patient surface, <23" in height, scale system, side rails with release, foot end nursing controls, transfer boards, integrated pump rack, IV pole, powered back rest, and litter mounted oxygen bottle holder. 4. Statutory Authority Permitting Other Than Full and Open Competition: This request is pursuant to the authority of FAR Part 6.302-5 and Public Law 109-461 Sec 502 as codified in U.S.C § 8127(b). 5. The Nature of the Acquisition Requires Use of the Authority Cited: A. FAR Part 6.302-5 allows for the procurement of items through other than full and open competition; when a statute expressly authorizes or requires that the acquisition be made through another agency or from a specified source, or the agency's need is for a brand name commercial for authorized resale. Public Law 109-461 expressly authorizes the use of sole source awards to Service Disabled Veteran Owned Small Businesses if 1) such concern is determined to be a responsible source with respect to performance of such contract opportunity; 2) anticipated award with option is under $5,000,000 and 3) in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price that offers the best value to the United States. B. This acquisition for thirty-two Patient Transport Solutions is being acquired from Alliant Healthcare Inc. This company has passed all past performance checks and has had a positive history of successful transactions with this VISN. In addition, this contractor has provided this same item to this VISN in the past for a price higher than what is currently being offered due to economic conditions. This item when compared to other purchases made and heavily modified items that could possibly meet these requirements is cheaper and more effective for use within this VISN. Finally this award falls under $5,000,000. Thus under public law 109-461 and FAR Part 6.302-5, we shall sole this procurement to Alliant Healthcare, an SDVOSB contractor as certified by Vetbiz.gov. 6. A Description of Efforts Made to Ensure That Offers From as Many Potential Sources As Practicable and Whether a Notice Will Be Publicized. A Notice of intent has been publicized and synopsized under requirements stated in FAR Part 5. A notice of award shall be posted after award is made. 7. Anticipated Cost: The anticipated cost of this procurement presented by Alliant Healthcare Inc is fair and reasonable to the Government based on using service estimates and previous purchasing history of prices. In addition, negotiation has been utilized to bring the price down by an additional 4%. 8. Results of Market Survey: In accordance with FAR Part 10 Market Research, various VA and Federal Supply Schedules were thoroughly reviewed. It was found that Alliant was the only company that could provide a solution that could meet our needs with a reasonable price. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: None. See Items 5 above. 10. Any Other Interested Sources? There are no other sources that have expressed an interest to date. 11. A Statement of the Actions, if any, the Agency May Take To Remove of Overcome Any Barriers to Competition Before Any Subsequent Acquisition is required: As this is an SDVOSB Sole Source Procurement, removing barriers to competition for any subsequent actions would require that all goals of public law 109-461 be thoroughly met. Once these goals have been met as deemed by Congress, full and open market procurement of these items shall be attempted, though these items are rather unique due to the special features that these solutions have. 12.
