Description

DEPARTMENT OF VETERANS AFFAIRS VISN 22 NETWORK CONTRACTING ACTIVITY JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-1, 41 U.S.C. 253 (c) (1) 1. Agency and Contracting Activity Identification: The Department of Veterans Affairs VISN 22 Network Contracting Activity has a requirement for a mouse telemetry system for VA San Diego Healthcare System as described in transaction number 664-10-4-143-1633. 2. Nature of Acquisition Being Approved: To procure equipment from Data Sciences International (DSI) on a sole source basis. 3. Description of Supplies or Services to Meet Agency Needs: The DSI telemetry system for mouse is an eight (8) animal system configuration that records data from 8 animals simultaneously. The mice are implanted with DSI's implantable transmitters used to measure blood pressure and ECG. The system configuration includes: (8) PA-C10 mouse BP transmitters (used to measure blood pressure), (8) ETA-F10 mouse ECG transmitters (used to measure ECG), (8) RPC-1 receivers, (1) APR Ambient Pressure Reference, (2) Data Exchange Matrix with power supply, Dataquest A.R.T. Gold acquisition interface, and starter kits and surgical videos. 4. Statutory Authority Permitting Other Than Full and Open Competition: Contracting without providing for full and open competition is authorized by Citation 41 U.S.C. 253(c)(1), and by FAR 6.302-1 - Only One Responsible Source and no Other Supplies or Services will Satisfy Agency Requirements. 5. Demonstration of the Proposed Contractor's Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited: Data Sciences International does not use resellers or distributors in the United States and is a sole source provider of the PA-C10 and ETA-F10 implantable transmitters and the complete Physio Tel line of transmitters. In addition, the Dataquest A.R.T. acquisition interface developed by DSI is designed for use with DSI transmitters and is not produced or sold by any other company. 6. A Description of Efforts Made to Ensure That Offers Are Solicited From as Many Potential Sources as is Practicable and Whether a Notice Will Be Publicized: This requirement will be advertised as an intent to solicit and negotiate with only one source under the authority of 6.302, as required by FAR 5.203 7. Determination Anticipated Cost Will Be Fair and Reasonable: DSI's standard price for this system is $78,215.00. DSI is offering it to the VA at the discounted price of $60,980.00, which is deemed fair and reasonable. 8. Description and Results of Market Research or Statement why Market Research Was Not Conducted: A search of the GSA e-library using the keywords "mouse telemetry system" and "mouse telemetry" produced no results. A search of the SBA website using keywords "telemetry" and NAICS code 334516 - Analytical Laboratory Instrument Manufacturing produced one (1) result - UFI Inc. Per an e-mail from UFI Inc., they sell telemetry systems that are for human use only. A Google search produced one result - Millar Instruments, Inc. When contacted, the person that answered the phone, Blain, stated that the current system that they have now is for larger rats. They won't have a mouse system available until the first of the year. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: Other than the fact that I've utilized every source that I can think of to find competition, the only fact to support the use of procuring this equipment via sole source is that this equipment will be paramount to Dr. Sushil Mahata, Research Physiologist at VA San Diego, for his research studies. 10. List Any Other Sources That Expressed Interest in Writing? No sources have expressed an interest, in writing, in this acquisition. However, an FBO announcement announcing our intent to negotiate a sole source procurement will be publicized. 11. A Statement of the Actions, if any, the Agency May Take To Remove of Overcome Any Barriers to Competition Before Any Subsequent Acquisition is required: 12.
