Description

DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Organization: Department of Veterans Affairs, VISN 20, Puget Sound Medical Center, Seattle, WA. 2. Description of Action: This is a request for other than full and open competition for the annual preventive maintenance of five (5) CAT 3412 engine generators, one (1) CAT 3516 engine generator from NC Power Systems, Tukwila, WA. 3. Description of Supplies or Services: VHA Directive, The Joint Commission, NFPA 70 and 110: mandatory compliance. This requirement is a performance criterion essential to the emergency operation of the VA Medical Center's electrical emergency power distribution system. NC Power Systems is Caterpillar's only factory authorized power generation distributor of equipment, parts and service in the local area. The generators control panel is proprietary to Caterpillar. The required deliveries of services were scheduled for week of 19-23 July 2010 and are now past due. 4. Statutory Authority: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; (X) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement ( ) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5. Validity of Use of Statutory Authority: IAW FAR 6.302-1 (a)(2) NC Power Systems is the only local vendor that is factory authorized to service this equipment. IAW FAR 6.302-2(a)(2)(b)(2) delay in the award of this requirement could result in serious injury to our Veterans. Services performed by unauthorized vendors and the installation of unauthorized parts could result in costly damage to equipment. 6. Actions to Promote Competition: IAW FAR 5.202(a)(2) the proposed contract action is urgent and compelling. Caterpillar has identified NC Power Systems as their only local factory authorized vendor. Prior to the award of a new contract, market research will be conducted for new authorized vendors in our area. 7. Determination of Fair and Reasonable Price: The anticipated price to the Government is $10,365.00. IAW FAR 13.106-3(a)(2)(ii), based on the analysis of historical costs for previous services performed by the vendor, pricing is determined fair and reasonable. The referenced purchase orders for historical costs are 663-C90644 and 663-C90024. 8. Market Survey (FAR 7.102): Other vendors were found through market research that could perform the required services, however, they are not factory authorized to perform services. 9. Other Considerations: NC Power Systems has unique and exclusive capabilities to provide factory authorized parts and accessories to meet the primary consideration of compatibility and installation compliance in the mechanical execution of work as defined in the NFPA. They installed the system in 1983 and as the only factory authorized vendor they have performed all maintenance and repairs since that time. Caterpillar and its integral components of this brand/model are installed in the VA, Seattle Electrical Emergency Power Supply; the use of another product brand/model would require considerable time and evaluation considering the product is not readily available. 10.
