Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1. Contracting Organization: Department of Veterans Affairs, VISN 20, Puget Sound Seattle VA Medical Center 2. Description of Action: This justification for other than full and open competition for a Traumacad server software to be performed by orthopedic surgeons. 3. Description of Supplies or Services: This requirement specialized for templating orthopedic patients that are in need of total joint replacement. 4. Statutory Authority: ( X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; ( ) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement ( ) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5. Validity of Use of Statutory Authority: IAW FAR 6.302-1 (a)(2) this test is uniquely offered by only one vendor. IAW FAR 6.302-2(a)(2)(b)(2) delay in the award of this requirement will result in specimen decay and inability to perform the test. This delay could result in serious injury to the Government and its ability to service its Veterans. 6. Actions to Promote Competition: The contracting officer attempted to purchase this software from a SEWP schedule-holder since software is considered an IT purchase. When no vendor submitted a quote, the contracting officer contacted VoyantHealth, manufacturer of the TraumaCad software to see whether they had any authorized distributors. VoyantHealth stated they were the sole provider of this software. The contracting department will continue to seek competition for IT orders in the future. 7. Determination of Fair and Reasonable Price: VoyantHealth ™s price is fair and reasonable IAW FAR 13.106-3(a)(2)(vi). Their quote is for $49,000, which is significantly lower than the $89,800 independent Government estimate. 8. Market Survey (FAR 7.102): The Government sought mandatory schedule-holders on SEWP to perform this contract. When none of them were able to offer this software, the contracting officer discovered that VoyantHealth is the sole provider of this product.
