Description
DEPARTMENT OF VETERAN AFFAIRS PALO ALTO HEALTH CARE SYSTEM 3801 MIRANDA AVENUE PALO ALTO, CALIFORNIA 94304 JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Upon the basis of the following Justification and Approval, the proposed contract described below may be established through other than full and open competition pursuant to the authority of 38 U.S.C. § 8127(b) as implemented by IL 049-07-08 and in accordance with the "Veterans First" program under (PL) 109-461. These provide for award in the event a single source is found with pricing considered fair and reasonable. 1.CONTRACTING AGENCY: The Department of Veterans Affairs, VISN 21, Consolidated Contracting Agency is responsible for the contracting action as described herein and will enter into a contract that requires justification for other than full and open competition. The solicitation number is VA-261-10-RP-0191. 2.DESCRIPTION OF ACTION: The request is being procured exclusive of competition, for a specific vendor, on a sole-source basis. The award will be made to Hughes Group, LLC, as a firm fixed price contract. The projected period of performance is a basic year plus four option years. 3.DESCRIPTION OF SUPPLIES/SERVICES: This procurement is for aseptic and nonaseptic janitorial services at the VA Palo Alto Outpatient Clinic., 13663 Mono Way, Sonora, CA 95370. The estimated price of the contract is $650,000.00. 4.AUTHORITY CITED: This service is being procured pursuant to VAAR 819.7008; Sole Source Awards to service-disabled veteran-owned small business concerns. Also FAR 6.302-2(a)(5) which provides for purchase from a sole source in accordance with the "Veterans First" program under 38 USC 8127(b). The preceding cited authority provides for purchase from an SDVOSB provided: (1) The anticipated award price of the contract (including options) will not exceed $5 million; (2) the requirement is synopsized in accordance with FAR Part 5; (3) The SDVOSB concern has been determined to be a responsible contractor with regard to performance; and (4) award can be made at a fair and reasonable price. The contracting officer's determination whether to make a sole source award is a business decision wholly within the discretion of the contracting officer. A determination that only one SDVOSB concern is available to meet the requirement is not required. 5.ANNOUNCEMENT OF REQUIREMENT: This solicitation will be advertised in Fedbizopps as a direct award due the authority cited in #4 above. 6. EFFORTS TO OBTAIN COMPETITION: Due to the circumstances described in #4 above, competition will not apply to this action. 7.FAIR AND REASONABLE DETERMINATION: A Price Negotiation Memorandum will be prepared which will detail the actions taken by the Contracting Officer to ensure fair and reasonable pricing. MARKET RESEARCH: Market research was conducted to locate a qualified SDVOSB to make a direct award as authorized in public law 109-461. Hughes Group is a SDVOSB and they are currently providing Janitorial Services at several facilities within VISN 21. Two of their larger contracts estimated at approximately $150,000 per year are VA261-P-0782 in Fremont, Ca. and VA261-P-0726 in Santa Rosa, Ca. The prices provided in both of those contracts was determined to be fair and reasonable and we anticipate the same for this solicitation. Hughes Group performance under both of those contracts has been good with no major problems identified. 9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COM PETITION: Due to the circumstances described in #4 above, no competition will apply to this action. 10. INTERESTED SOURCES: Award to be made to Hughes Group, LLC of Lakewood, WA. 11. AGENCY ACTIONS TO INCREASE COMPETITION: Due to the circumstances described in #4 above, no competition will apply to this action. 12.
