Description
Approved J&A JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION I. CONTRACTING ACTIVITY The 31 Contracting Squadron on behalf of 31 Logistics Readiness Squadron; intends to procure repair parts for a Halverson 25K loader under a Sole Source Acquisition to John Bean Technologies Corporation, DBA JBT AeroTech. This Justification and Approval for Other than Full and Open Competition pertains to items requested under Purchase Request number F1F2C30229A001. II. NATURE AND/OR DESCRIPTION OF THE ACTION BEING PROCESSED A new fixed-firm-priced contract will be awarded as a result of this acquisition. III. DESCRIPTION OF THE SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY'S NEEDS The following parts are required to repair registration number 07E00054, Halvorsen 25K cargo loader; Part Number QTY Description Total Price. 623-6100 1 A-HANDRAIL AND WALK DECK $9,309.53 623-8593 4 PIN, QUICK RELEASE L 5/8 $245.04 623-8592 4 PIN, QUICK RELEASE L 5/8 $425.56 623-7324 1 AE-MARKER LIGHT, AMBER $32.66 623-6875 1 W-HANDRAIL CENTER $493.90 ESTIMATED SHIPPING COST $850.00 TOTAL ESTIMATE $11,356.69 These parts must meet manufacturer specifications. Once parts are received by 31LRS/LGRV Vehicle Management flight they will be installed on site by 463L mechanic. IV. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN COMPETITION 10 USC 2304(c)(1), as implemented by FAR 6.302-1(a)(2)(iii) (FAR 6.303-2(a)(4)). V. DEMONSTRATION THAT THE CONTRACTOR'S UNIQUE QUALIFICATIONS OR NATURE OF THE ACQUISITION REQUIRES THE USE OF THE AUTHORITY CITED ABOVE (APPLICABILITY OF AUTHORITY) JBT AEROTECH is the AF wide supplier of these parts under a supply system. In circumstances where damage is caused due to negligence, the owning unit, AMC in this case is required to pay for repairs utilizing an in place Acquisition process. Approval was granted in this case from Program CO and JBT Program Manager to create a local Purchase order for the parts. VI. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE SOLICITED FROM AS MANY POTENTIAL SOURCES AS DEEMED PRACTICABLE Thorough market research was accomplished prior to the sole source approval. VII. DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE The prices provided by the contractor are the same prices that are contained on their standing price list. This Price list is deemed fair and reasonable on an AF contract, and is in use for Supply style parts issue. VIII. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE RESULTS, OR A STATEMENT OF THE REASONS MARKET RESEARCH WAS NOT CONDUCTED The Program manager for JBT AeroTech was contacted; he indicated that JBT AeroTech is the only supplier of Halverson 25K Loader parts. The program Manager stated, with the exception of accidental damage, the AF wide contract replaces all parts. Since this is an accidental damage case, authorization for local purchase, against standard procurement procedure was obtained from AFMC Program Contracting Officer. IX. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION JBT AEROTECH owns all the patents for the spare parts for the 25k loader. X. LIST OF SOURCES, IF ANY, THAT EXPRESSED INTEREST IN THE ACQUISITION N/A XI. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE MAKING SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES REQUIRED The program contract for the production of the Halverson loader and its repair parts was competed and awarded at the AFMC level. This is a one-time local purchase Halverson repair parts contract due to constriction of end year fiscal 2010 funds. XII. CONTRACTING OFFICER'S CERTIFICATION The contracting officer's signature on the Coordination and Approval Document evidences that he/she has determined this document to be both accurate and complete to the best of his/her knowledge and belief (FAR 6.303-2(a)(12)). XIII. TECHNICAL/REQUIREMENTS PERSONNEL'S CERTIFICATION As evidenced by their signatures on the Coordination and Approval Document, the technical and/or requirements personnel have certified that any supporting data contained herein, which is their responsibility, is both accurate and complete (FAR 6.303-2(b)).
