Description
The awarded contract is for Counter-Surveillance and Surveillance Detection Support Services for the U.S. Marshals Service. The services being procured include (1) subject matter expert consulting; (2) training; and (3) operational support. The awarded contract type is an Indefinite Delivery, Indefinite Quantity Labor Hour Contract with Fixed-Price and Cost-Reimbursement type line items. Determinations and Findings (D&F) for Labor-Hour Contract CS/SD Services Contract FINDINGS: 1. Contracting Office: This D&F is prepared by the U.S. Marshals Service, Headquarters Contracts Branch. 2. Nature of the Action: Authority to use a labor-hour contract. 3. Description of the Action: To acquire Counter-Surveillance/Surveillance Detection services. 4. Regulation upon which the D&F is based: The regulations permitting the use of labor hour contracts are FAR subpart 16.602 and JAR 2616.602. 5. Findings that Support the Determination: a. The use of a labor-hour contract is necessary because it is not possible, at this time, to estimate with any degree of accuracy, the extent or duration of the some of the specific services (namely, operational support) that will be required during the period of performance of this contract. b. The operational support services will be acquired on the basis of direct labor hours at specified fixed daily rates that include wages, overhead, general and administrative expense, and profit. c. The contract will include specific performance requirements, standards, and measurements that will be closely monitored by the COTR and Contracting Officer to ensure that efficient methods are used. d. The contract will be structured as an Indefinite Delivery/Indefinite Quantity contract. Task Orders will be placed against specific CLINs as the need for those services arise. Each Task Order placed against a Labor-Hour CLIN will specify the number of contractor man-days to be provided, the place of performance, the period of performance, and the price (based on the stated man-day rate in the base contract). e. In accordance with FAR 52.232-7, Payments Under Time-and-Material and Labor-Hour Contracts, the Contracting Officer shall withhold five (5) percent of the amount due under the Labor Hour CLINs (not to exceed $50,000) until the Contractor executes and delivers a release. DETERMINATION: For the reasons listed above, it is determined that a labor-hour contract is the most suitable type of contract for this requirement.
