- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This procurement is being conducted under Simplified Acquisition procedures pursuant to the authority of FAR Subpart 13.5, Test Program for Certain Commercial Items (10 U.S.C. 2304(g) & 2305 & 41 U.S.C. 253(g) & 253a & 253b), FAR Part 12, Acquisition of Commercial Items (Title VIII of the Federal Acquisition Streamlining Act of 1994 (Public Law 103-355)), & FAR 37.4, Non-personal Health Care Service (10 U.S.C 2304 & 41 U.S.C. 253). This announcement constitutes the only solicitation; therefore, a written solicitation will not be issued. The Aberdeen Area Indian Health Service (IHS) intends to award a firm fixed-price purchase order in response to Request for Quotation (RFQ) RFQ-11-009. The solicitation documents & incorporated provisions & clauses are those in effect through Federal Acquisition Circular 2005-16. The associated North American Industry Classification System code is 621111. PRICE SCHEDULE: BASE YEAR: 200 hours (1 day per week for 25 weeks) @ tiny_mce_marker__________________ per day = tiny_mce_marker___________________. The quoted "unit price" must be an all-inclusive cost. All "inclusive unit price" is defined to include travel, lodging, per diem, fringe benefits, federal, state and local taxes (contact the local Tribal TERO Office to see if taxes are applicable), plus all other costs pertinent to the performance of this purchase order. STATEMENT OF WORK: BACKGROUND: The Cheyenne River Service Unit is in need of services from contractor to provide routine and high risk obstetrical and gynecological services. The service unit requires contractor support to provide temporary duties of a board certified OB/GYN physician. Currently, the Cheyenne River Service Unit provides emergency OB/GYN services. No routine OB/GYN services are available within current staffing. PURPOSE OF THE CONTRACT: The purpose of this contract is to provide medical and surgical care to women with particular expertise in pregnancy, child birth, and disorders of the reproductive system. This includes preventative care, prenatal care, detection of sexually transmitted diseases, pap tests screening, family planning, etc. These services shall be as comprehensive as the Indian Health Services supplied facilities, equipment and support services permit, while complying with JCAHO/CMS accreditation standards. TASKS: The contractor shall furnish an obstetrical and gynecological (OB/GYN) physician for primary care services at the Eagle Butte I.H.S. The contractor shall perform OB/GYN services compatible with the Eagle Butte I.H.S. medical facilities operating capacity and equipment. The contractor shall provide OB/GYN physician services for the Indian Health beneficiary service by the Cheyenne River Service Unit. Contract performance shall be according to the requirements contained in this statement of work. SPECIFICATIONS & STANDARDS: 1) Contractor is required to indemnify the Government for any liability producing act or omission by the contractor, the contractor's employees, and agents occurring during the contract performance. 2) Contractor is required to maintain medical liability insurance, for the contractor, the contractor's employees, and agents, acceptable to the contracting officer, which is not less than the amount normally prevailing within the local community for the medical specialty concerned. 3) Require the contractor to ensure any subcontracts for provisions of health care services, contain the requirements of the Clause (a FAR 52.237-7, including the maintenance of medical liability insurance. 4) Medical services shall not be performed by a contract OB/GYN physician until professional staff membership and clinical privileges have been granted in writing by the Indian Health Service Governing Body. As a prerequisite to performance under the resultant contract the contractor performing the services must be privileged in accordance with Indian Health Service/Aberdeen Area credentialing policy. Therefore compliance with the Indian Health Service privileging requirements is essential in tile performance of the contract. Any failure to comply with the IHS privileging requirements shall be considered nonperformance of the contract. The Governing Body will not grant clinical privileges until it is determined that credentials have been verified. Exceptions to tile IHS credentialing review and clinical privilege process will not be considered. Any contractor who fails to maintain medical staff appointment and c1inical privileges will not be permitted to perform services under the contract and shall be promptly replaced. 5) The services provided by the OB/GYN physician shall include but not limited to outpatient care and procedures: colposcopy with biopsy, endometrial biopsy. Cryosurgery, vulvar biopsy and inpatient/ER/UCC consultation. 6) The contractor shall provide patients with a full explanation of diagnosis, procedures and treatments. 7) The contractor may be involved in health promotion and disease prevention activities by advising patients about the advantages of healthy lifestyles and specific measures that my prevent recurrences of ill health. 8) The contractor shall initiate a drug therapy regimen, as indicated using the IHS/Service Unit Drug Formulary whenever possible. If not possible, request for Non-Formulary Drug Purchase will be completed by the contractor. 9) The contractor shall provide adequate credentialed staff during the regular scheduled services dates and cover the salary for any ancillary staff brought to the service unit. Ancillary staff must have licensure/certification and competencies on file with Contracting Officer. QUALIFIC ATIONS/CREDENTIALING: 1) The contractor shall be board certified, or board eligible by the American College of Obstetrics and Gynecology. It is a condition of this contract that all required certification in this statement of work remain current during the life of this contract. 2) The contractor must hold a current, unrestricted state medical license from any of the 50 United States or the Commonwealth of Puerto Rico. 3) The contractor shall submit documents required in accordance with the Indian Health Service Circular No. 95-01 to the Medical Staff Credentials Coordinator upon contract award. Each physician providing services must be credentialed and granted clinical privileges by the Service Unit prior to providing services. The contractor must obtain and complete appropriate appointment forms at the service unit, even if the contractor provides services at another IHS facility. 4) The contractor shall meet the same privileging requirements as permanent IHS physicians before being allowed to provide medical services at the Eagle Butte IHS facility. 5) The contractor shall not have any work or health restrictions which interfere with the performance of OB/GYN services. 6) The contractor shall speak. Understand, read and write English fluently and communicate with sufficient clarity to be understood by the Eagle Butte Indian Health Service Hospital personnel and patients. The contractor shall possess sufficient initiative, interpersonal relationship skills and social/cultural sensitivity such that he/she can relate constructively to patients for the Eagle Butte community. 7) The contractor shall maintain standards of personal hygiene and grooming such that his/her image as 311 OB/GYN physician is compatible with the expectations of the Eagle Butte Indian Health Service Hospital clinical staff and the Indian community. 8) Background Investigation: Duties and responsibilities, which involve regular contact with or control over Indian children are subject to a character investigation. The IHS Personnel Office will conduct these investigations following the award of a contract unless in the judgment of the contracting officer, in consultation with the Personnel Officer, the investigation is waived based on prior investigations file. Until the character investigation has been completed and the contracting officer is notified, the individuals providing services shall not have unsupervised contact with Indian children. GOVERNMENT FURNISHED PROPERTY. FACILITIES AND SERVICES: The Service Unit shall provide office space including a desk, chair, and office supplies. The contract physician will be authorized to use all areas of the medical treatment facility available to civil service and commissioned personnel in similar positions. The same restrictions apply to the contractor as any other Indian Health Service personnel to use these areas for official business activities only. The contract physician shall be authorized to use all administrative support: administrative support shall include assistance in scheduling and contacting patients as necessary. This will also include but not limited to copy machine, tele-fax machines, and telephone service. The same restrictions to use these items for official Indian Health Service business apply. The service unit will provide an orientation to the Indian Health Service and the Indian community being served. The initial orientation and continuing orientation shall be provided by the service unit personnel. The service unit shall provide medical and non-medical equipment and supplies used in the Eagle Butte Indian Health Service facility for the care and management of patients. CONTRACTOR FURNISHED PROPERTY. FACILITIES AND SERVICES: The Indian Health Service does not anticipate a need for contractor furnished equipment. The contractor shall provide the contract physician with an appropriate white physician coat and personal physician items such as stethoscopes, pen lights, etc. The service unit shall provide all required Government forms applicable to the Indian Health Service, these are to be used by the contractor. An orientation of the appropriate forms will be provided by the service unit personnel. PROGRAM MANAGEMENT AND CONTROL REQUIREMENTS: The service unit shall provide an ongoing method of monitoring and evaluation of the quality and appropriateness of patient care and of identifying deficiencies in the quality of services performed before the level of performance becomes unacceptable. The standards of medical practice and duties of the contractor through its OB/GYN physician shall be determined pursuant to the bylaws of the Eagle Butte Indian Health Service Hospital, the regulators of the hospita1, applicable provisions of law, and other rules and regulations of any/all governmental authorities relating to licensure and regulations of physicians and hospitals, and all the standards and recommendations of the Joint Commission on Accreditation of Healthcare Organizations/CMS. The contractor shall be required to participate in a quality improvement program which is consistent with current Joint Commission of Accreditation of Healthcare Organizations (JCAHO)/CMS requirements for ongoing monitoring and evaluation of the quality and appropriateness of care. This will include compliance with CMS Regulation including application for Medicare provider number and reassignment of benefits. The work shifts may be established at the time of the contract award and may be adjusted when mutually agreed upon. Services shall normally be every Wednesday between 9:00 am and 4:00 pm, with a l hour lunch break. Contract performance shall not be scheduled during Federal Holidays. The contractor is expected to be available during the entire clinic day. The contractor may leave before 4:00 pm with the approval of the Project Officer, providing all scheduled patient care is completed. Period of performance to be 10/15/2010 to 4/15/2011. Prior to assumption of duty on any scheduled work shift, the contractor may be briefed by the service unit Contracting Officer concerning any mailer relevant to the contractor's assumption and discharge of responsibilities under the terms of the contract. The contractor shall advise the Project Officer or designated representative of any patient care problems encountered, or which may be encountered. The briefing shall include conditions of any emergency for which the contractor may reasonably be expected to attend during the work shift. All referrals to private facilities or providers for specialized diagnostic studies or definitive care not offered at the Eagle Butte IHS facility shall follow Indian Health Service regulations and policies on patient referrals. The service unit shall provide an ongoing method of monitoring and evaluation of the quality and appropriateness of patient care, such as peer reviews, chart reviews and other means deemed necessary as directed by clinical director, to identify deficiencies in the quality of services performed before the level of performance becomes unacceptable. The contractor shall comply with all IHS infection control/employee health and safety procedures, practices, and standards. The contractor shall respect and maintain the basic rights of patients, including personal dignity and patient confidentiality. The contractor shall adhere to the HHS Standards of Conduct required for all federal government employees. The contractor shall complete a Patient Care Component (PCC) document and charge ticket for each patient seen during the clinic day. The PCC and charge ticket shall be completed and legible prior to the contractor's departure from the service unit. The contractor shall comply with the requirements of the Indian Child Protection and Family Violence Prevention Act (Public Law 101-630) and Section 231 of the Crime Control Act (Public Law 101-647). The service unit shall assist the contract providers in processing the necessary paperwork for conducting background Investigations on those providers who will have contact with Indian children in Indian Health Service facilities. Included in this requirement is a waiver provision that will permit certain contract providers to begin work prior to the completion of the full background investigation. The contractor shall comply with the Health Insurance Portability and Accountability Act (HIPAA) mandates particularly the requirements that relate to the protection of patient information. Upon the completion of the Indian Health Service HIPAA compliance plan, each contract provider shall receive an orientation on his specific responsibilities. The contractor shall comply with Privacy Act training. The contractor shall have a Unique Physician Identification Number (UPIN) and National Practitioner Identifier (NPI) for billing purposes under Medicare Part B. Under Section 1861 (r) of thee Social Security Act of 1985, the Centers for Medicare and Medicaid Services (CMS) is required to establish a unique physician identifier for each physician who provides services for which payment is made under Medicare Part B billing. One UPIN/NPI is assigned to a physician regardless of the number of practice settings and the UPIN/NPI is assigned throughout the physician's Medicare affiliation in any state. All IHS and contract providers are required to indicate on Medicare Part B claim forms the UPIN's for the ordering or referring physicians. Medicare requires that contractors will use the UPINs in claims for services to identify physicians who order services for Medicare patients or refer their Medicare patients for services. The contractor shall complete an "Authorization to Furnish Information and Assignment of Benefits" document to assign third party benefits to the Eagle Butte IHS Hospital. All third party payments resulting from the provision of contracted services shall revert to the service unit. The contractor shall not be considered an IHS employee for any purpose. A sign-in/sign-out log shall be maintained in the specialty clinic office. The contractor and their ancillary staff shall sign-in upon arrival at the service unit and sign-out upon departure. Review of the sign-in/sign-out shall be performed by the project officer, prior to payment of invoices to ensure hours requested are actual hours worked. Failure of contractor personnel to adhere to the above sign-in/sign-out requirements may have adverse effect on the processing of invoices and delay payments. Also, failure to comply with the strict intent of the sign-in/sign-out procedures may be considered a breech of the contract and may be considered as grounds for default. REPORTING REQUIREMENTS AND DELIVERABLES: The contractor shall submit a monthly status report to the Project Officer: Lisa Veit RN, Project Officer, Cheyenne River Service Unit, PO Box 1012, Eagle Butte, SD 57625, (605) 964-3004 ext.106. Status report shall include: A description of contract activities accomplished during the reporting period including the number of patients seen. Any problems that have arisen or remain unresolved since the last report. The Contractor shall discuss the means to be taken to resolve pending problems. Number of contractor staff present per clinical day and number of hours spent on direct patient care. Any recommendations and implementation plans resulting from any task. INVOICE SUBMISSION & PAYMENT: The Contractor shall submit a signed invoice to the Project Officer at the Hospital for approval on a least a monthly basis. The Contractor shall submit an original invoice to Accounts Payable, Aberdeen Area Indian Health Service, Division of Financial Management, 115 4th Ave SE, Room 309 Federal Building, Aberdeen, South Dakota 57401. The Contractor agrees to include the following information on each invoice: 1) Contractor's name, title, address and telephone number; 2) award number; 3) invoice number and date; 4) cost or price; 5) dates of service including number of hours worked; and 6) DUNS number and Tax Identifying Number (TIN). Payment shall be made by the Aberdeen Area Financial Management Branch, 115 4th Ave SE, Room 309 Federal Building, Aberdeen, South Dakota 57401. PROPOSAL SUBMISSION INSTRUCTIONS: All responsible offerors may submit a proposal, which shall be considered by the Agency.
