Description
DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Organization: Department of Veterans Affairs, VISN 20, VA Puget Sound Health Care System, Pathology & Laboratory Service. 2.Description of Action: This is a request for other than full and open competition for the procurement of water services and consumables from Siemens Water Technologies at both divisions of the Pathology & Laboratory Service at the VA Puget Sound Health Care System. This service has been provided under contract V663P-6008-05 / VA663-C00081 for VA Puget Sound Health Care System which expires 9/30/2010. Siemens Water Technologies, will be awarded a bridge contract for a period of six (6) months, effective 10/1/2010. This bridge contract will insure the continuity of this critical service during the solicitation and award process. 3.Description of Supplies or Services: Maintenance services and consumables for the water systems currently in place at both laboratories, to provide de-mineralized water to process lab tests for quality control purposes. 4.Statutory Authority: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements; (X) (2) Unusual and Compelling Urgency; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability, or Expert Services; ( ) (4) International Agreement ( ) (5) Authorized or Required by Statute; ( ) (6) National Security; or ( ) (7) Public Interest 5. Validity of Use of Statutory Authority: The Siemens Water system filters water that is supplied to the chemistry analyzers which test more than 75% of the total patient samples (over 5 Million tests a year) for the entire VA Puget Sound, at Seattle, Tacoma, and all CBOC's in the area. The quality and quantity of the water that is used was calibrated to run in the Cobas Chemistry Analyzers, and filters, parts, and preventive maintenance service ensures that water quality will be correct to be used with the chemicals in the Chemistry Analyzer. Currently, that is calibrated to the Siemens Water System, which is attached to the lab Analyzers. Should the Siemens Water system fail, the entire analyzer system will shut down, and testing of patients for such critical tests as glucose and potassium stop. This could result in delays to patient treatment. 6.Actions to Promote Competition: A procurement for Full and open competition is currently in the acquisition planning phase. 7.Determination of Fair and Reasonable Price: The anticipated price to the Government is $11,500.00, which is the same as the pricing in the current purchase order that expires on 30 September 2010, and is determined to be fair and reasonable. Ref: PO# 663-C00081. 8.Market Survey (FAR 10): Market research was not conducted due to the compelling urgency of this requirement. 9.Other Considerations: FAR 6.302-2(b)(2) states that "Delay in award of a contract would result in serious injury, financial or other, to the Government". 10.Listing of Sources that expressed, in writing, an interest in the acquisition: N/A 11.Statement of Actions to Overcome Barriers to Competition: This bridge contract is temporary measure that will insure the continuity of this service during the solicitation and award process for the new contract. 12.Requirements Certification: I certify that the requirement outlined in this justification is a bona fide need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief. //Signed//09/27/2010 _____________________________________________________ Patricia GosciewskiDate Laboratory Supervisor VA Puget Sound Health Care System 13.Approvals in accordance with FAR 6.304 Contracting Officer's Certification: I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. //Signed// 09/27/2010 ____________________________ _________________________ Craig S.
