- The contractor shall provide shall furnish food, facilities, furniture, equipment, supplies, management, supervision and labor, within 7 miles of the VA-LETC for students attending the Department of Veterans Affairs (VA) Law Enforcement Training Center (LETC). The period of performance is from 1 Oct 2010 through 30 Sep 2015. The solicitation was issued using a cascading procedure as follows: In accordance with FAR Subpart 19.14 and PL 109-461, award under this solicitation will be made on a competitive basis first to an eligible Service Disabled Veteran Owned small business (SDVOSB) concern (see Section K, FAR 52.219-1, "Small Business Program Representations" for small business size definition) who submits a responsive offer, where award can be made at a fair market price. If award cannot be made to a SDVOSB concern, award will be made to an eligible Veteran Owned Small Business (VOSB) concern. If award cannot be made to a VOSB concern, award will be made to an 8a or HubZone small business concern. If award cannot be made to an 8a or HubZone concern, award will be made competitively to a small business concern IAW FAR 19.5. If there is inadequate competition for award and only one acceptable offer is received from a SDVOSB, VOSB, 8(a), or HUBZone small business, the contracting officer will make an award when it can be made at a fair market price following the cascade approach stated above. If there is inadequate competition for award and only one acceptable offer is received from a small business, the small business's offer will be included with offers received on an unrestricted basis and the solicitation will be competed unrestricted.` Adequate competition shall be deemed to exist if- At least two competitive offers are received from qualified, responsible business concerns at the tier under consideration; and Award will be made at fair market prices as determined in accordance with FAR 19.202-6. Using the above procedures, no proposals were received from SDVOSB businesses. One proposal was received from a VOSB and was found responsive and their offer was at a fair market price and they were registered in the Vet Biz Registry at the time of due date for offers. Therefore an IDIQ type contract was awarded with task orders to be issued for requirements.
