- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION I. CONTRACTING ORGANIZATION: The contracting organization responsible for this action is the 4th Contracting Squadron, 1695 Wright Brothers Avenue, Seymour Johnson AFB, NC, 27531. II. DESCRIPTION OF ACTION: The contractual action is a sole source firm-fixed price contract for the installation of Time Warner Cable line to Building 4916. This will provide required broad band service the meets minimum upload and download speeds to the newly installed KC-135R flight simulator. III. DESCRIPTION OF SUPPLIES/SERVICES: The requirement is to provide installation and connection of 7M x 768K cable for the capability to access Time Warner broadband service to the KC-135R Flight Safety Instructors. IV. AUTHORITY: The statutory authority permitting other than full and open competition for this acquisition is 10 U.S.C. 2304(c) (1) and the Federal Acquisition Regulation Part 6.302-1. V. APPLICABILITY OF AUTHORITY: Time Warner, is the only vendor that can complete this installation. The cable infrastructure in place at Seymour Johnson AFB is installed, operated and serviced by Time Warner. VI. EFFORTS TO OBTAIN COMPETITION: Time Warner cable is the only provider of cable service in Eastern North Carolina. Two Satelllite vendors, Direct TV and Dish Network, were consulted concerning service to Bldg 4916 but cannot provide enough bandwidth to meet Flight Safety's requirements as mandated in Flight Safety's support contract which requires the Government to provide broad band cable access. VII. FAIR AND REASONABLE COST: The Contracting Officer will determine the pricing to be fair and reasonable prior to award. VIII. MARKET SURVEY: It was confirmed with the provider, Time Warner, that the company has no authorized distributors; the manufacturer has exclusive rights to the required infrastructure. IX. OTHER FACTS: N/A X. INTERESTED SOURCES: N/A XI. STEPS TO FOSTER COMPETITION: Market research will be conducted to see what other equipment or systems exist when the current central (base) equipment/system is due for re-competition. If there are other cost effective options at that time the Government will explore those alternatives. XII. TECHNICAL REQUIREMENTS/PERSONNEL CERTIFICATION: The using activity has certified that the technical requirements are complete and accurate. XIII. CONTRACTING OFFICER'S CERTIFICATION: The Contracting Officer's signature on the Justification Review Document represents certification that the justification is accurate and complete to the best of his/her knowledge.
