Description
USE OF LABOR HOUR CONTRACT The Internet Monitoring and Analysis Support contract is Labor Hour (LH) contract due to the inability to predict future criminal activity regarding expansive areas of content related to FDA regulated products. Since the nature of work can affect national security it is important to incorporate flexibility into the contract. OCI anticipates requiring standard services but may need the contractor to expedite deliverables or change focus to another area of content (within scope) within 24hrs. FINDINGS 1. At this time, it is not possible to estimate accurately the extent or duration of the work, or of the anticipated costs with any degree of confidence.. 2. A cost-reimbursement contract would be unacceptable as the program office is unable to accurately describe the majority of the work to be performed, unable to estimate the costs up front and, consequently, unable to evaluate a cost proposal. 3. Services will be provided by the contractor utilizing the services of negotiated labor categories at specific fixed hourly rates. The hourly rates are fully burdened. 4.The Government anticipates materials and labor costs to be associated with some of the emergencies or national security efforts. 5.Government surveillance of contractor work / performance will be by the Contracting Officer's Technical Representative (COTR). COMPETITIVE In accordance with FAR 6.203 the Internet Monitoring was competed. 17 proposals were received and an award was made without discussions based on best value to the Government.
