Limited Source Justification MEMORANDUM FOR THE FILE FROM: JASON GIETL CONTRACTING OFFICER, 5PSSD1A SUBJECT: Limited Source Justification 1. IDENTIFICATION AND DESCRIPTION OF ACTION BEING APPROVED This proposed action involves contracting for emergency water cleanup services at the E. Ross Adair Federal Building and US Courthouse, 1300 S. Harrison St., Ft. Wayne, Indiana, 46802. •2. DESCRIPTION OF SERVICES REQUIRED This contract requires that the contractor provide all labor, supervision, supplies and equipment to clean up water due to a faulty cooling pipe. The Independent Government Cost Estimate is $4,594.00. 3. IDENTIFICATION OF STATUTORY AUTHORITY Authority for this action is provided per FAR 13.106-1(b), "contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g. urgency)" 4. DEMONSTRATION THAT THE ACQUISITION REQUIRES USE OF AUTHORITY CITED This procurement action is being undertaken due to a safety issue concerning water damage and to avoid potential damage and harm to the people and building as well as its contents, this work must be accomplished immediately. •5. DESCRIPTION OF EFFORTS TO SOLICIT AS MANY OFFERS AS PRACTICABLE One contractor, Synergid dba Paul Davis Restoration of Northeast Indiana, has been identified as the most promising contractor for providing the required services. Synergid dba Paul Davis Restoration of Northeast Indiana is being solicited for the following reasons: Synergid dba Paul Davis Restoration of Northeast Indiana is an experienced contractor with a good past performance. They are the local contractors who have extensive experience doing this type of work. •6. DEMONSTRATION THAT THE ANTICIPATED COST WILL BE FAIR AND REASONABLE GSA has prepared an independent Government Cost Estimate (GCE) to assist in the establishment of a fair and reasonable price. •7. No market survey will be conducted in the selection of the proposed contractor. Market data will be used to assist with the price reasonableness determinations as well as during price negotiations. •8. OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND OPEN COMPETITION Based upon the information provided in paragraph 5. Description of Efforts to Solicit As Many Offers as Practicable, and given the timeframe and the safety issue, the firm that we believe can provide the best service is Synergid dba Paul Davis Restoration of Northeast Indiana. •9. LIST OF SOURCES THAT EXPRESSED INTEREST IN THE ACQUISITION Request for Proposals will be limited to the following contractor(s): Synergid dba Paul Davis Restoration of Northeast Indiana 3010-1 Butler Ridge Parkway Fort Wayne IN 46808 •10. STATEMENT OF ACTIONS TO OVERCOME BARRIERS TO COMPETITION Given the unique and unusual circumstances of this situation, there are no actions that could be taken to remove or overcome the existing barriers to competition. The need to acquire the stated services in the manner proposed is due to the short time available from when the scope of work is defined to when the services are required to protect the safety of the facility occupants. 11. CERTIFICATIONS Due to the urgency of the need, traditional procurement procedures must be bypassed in favor of emergency procurement methods. It is therefore recommended that the services be acquired through the use of Volunteer Restoration and that the Request for Proposals be limited to the one contractor listed above.
