Description
This is the List of Parts requested and a Brand Name Justification. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Solicitation number W5K9FH-11-T-0008 is issued as an RFQ and a contract will be awarded following FAR Part 13 - Simplified Acquisition Procedures. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-46, Department of Defense Federal Acquisition Regulation Supplement (DFARS) current to DPN 20101025, Army Federal Acquisition Regulation Supplement (AFARS) Revision #25 dated April 1, 2010, and CENTCOM Contracting Command (C3) Acquisition Instruction dated August 2, 2010. The Regional Contracting Center aboard Camp Leatherneck, Afghanistan, has a requirement for Caterpillar repair parts: please see attachments for list of parts requested and Brand Name justification. The Delivery Address and Acceptance Point is: Camp Leatherneck, Unit 42285, FPO AP 96427-2285. The Required Delivery Date is: December 10, 2010. The provision at FAR 52.212-1, Instructions to Offerors - Commercial, applies to this acquisition. The Government will award a contract resulting from this solicitation to the technically acceptable quote with the lowest evaluated price (Lowest Price Technically Acceptable). Only quotes from contractors that can supply all the items requested and can deliver within the timeframe specified will be determined technically acceptable. Contractors must include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items, with their quote. The following FAR clauses apply to this acquisition: 52.212-4, Contract Terms and Conditions - Commercial Items; 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items; 52.203-3, Gratuities; 52.209-6 Protecting the Government's Interest When Subcontracting With Contractors Debarred, Suspended, or Proposed for Debarment; 52.203-6, Restrictions on Subcontractor Sales to the Government; 52.204-10, Reporting Executive Compensation and First-Tier Subcontract Awards; 52.222-19, Child Labor - Cooperation with Authorities and Remedies; 52.225-13, Restrictions on Certain Foreign Purchases; 52.232-33, Payment by Electronic Funds Transfer - Central Contractor Registration; 52.233-2 Service of Protest. The following DFARS clauses apply to this acquisition: 252.203-7002, Requirement to Inform Employees of Whistleblower Rights; 252.232-7008, Assignment of Claims (Overseas); 252.232-7010, Levies on Contract Payments; 252.233-7001, Choice of Law (Overseas); 252.212-7001, Contract Terms and Conditions Required to Implement Statutes or Executive Orders Applicable to Defense Acquisitions of Commercial Items; 252.203-7000, Requirements Relating to Compensation of Former DoD Officials; 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports; 252.247-7023, Transportation of Supplies by Sea, and 252.247-7024, Notification of Transportation of Supplies by Sea. The following C3 clauses apply to this acquisition: 952.232-0005, C3 Wide Area Workflow Instructions; 952.201-0001 Ombudsman; 952.225-0015, Subcontracting Requirements, and 952.233-0001, C3 Agency Protest Program.
