Description
DEPARTMENT OF VETERANS AFFAIRS VISN 22 NETWORK CONTRACTING ACTIVITY JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-2, 41 U.S.C. 253 (c) (2) 1. Agency and Contracting Activity Identification: VA Long Beach VISN 22 Network Contracting Activity, 5901 East Seventh Street, Long Beach, California, intend to enter into a Contract that will require justification for other than full and open competition. This VA Loma Linda, Healthcare System has a requirement for Main Hospital, Loma Linda, California 2. Nature of Acquisition Being Approved: Sole Source contract to a Service-Disabled Veteran-Owned Small Business (SDVOSB) under the provisions of Public Law 109-461. 3. Description of Supplies or Services to Meet Agency Needs: Contractor to furnish all labor, material, equipment and tools necessary to design-build services to repair one hundred and thirty-five (135) patient ceiling lifts and modifications to door entrances throughout the main hospital building. The estimated value of this contract is between $100,000.00 to $250,000.00. 4. Statutory Authority Permitting Other Than Full and Open Competition: The contract shall be issued under the authority of 41 U.S.C. 253(c) (5) permitting other than full and open competition, and per FAR Subpart 6.3, paragraph 6.302-2, Unusual and compelling urgency. In accordance with FAR 6.302 Circumstances Permitting Other than Full and Open Competition this statutory authority is cited as justification to award a sole source Service Disabled Veteran Owned Small Business contract valued more than $25,000 (simplified acquisition threshold) and less than $5,000,000 (authority ceiling limit). 5. Demonstration of the Proposed Contractor s Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited: This action requires the use of the cited authority in meeting the socio-economic goals established for the Department of Veterans Affairs. The proposed contractor (American Veteran Inc) meets the statutory criteria, and is registered and listed in the VetBiz registry as a Woman Owned and Service Disabled Veteran Owned Small Business contractor. 6. A Description of Efforts Made to Ensure That Offers From as Many Potential Sources As Practicable and Whether a Notice Will Be Publicized. Competition was not sought for this acquisition. Pursuant to 41 U.S.C. 253(c) (5) a sole-source set-aside is authorized for acquisitions for an amount more than the Simplified Acquisition Threshold but not exceeding $5,000,000. 7. Determination Anticipated Cost Will Be Fair and Reasonable: Negotiations and cost analysis will be conducted upon receipt of proposal. 8. Description and Results of Market Research or Statement why Market Research Was Not Conducted: In an effort to support VA s socio-economic goals, the undersigned conducted market surveys (via both VetBiz.com and the Central Contractor Registration web sites) for qualified SDVOSB enterprises. The contracting officer has validated that the contractor is registered and certified in the VA VetBiz.gov database and qualifies as small in accordance with federal small business size standards for the applicable North American Industry Classification System (NAICS) code assigned to the procurement. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: It is in the best interest of the patients, staffs and government to immediately move 78 fire sprinkler heads to different location, rewire/repair 135 existing patients lifts and widen SICU main door and bathrooms, 3SE-1 main door, 4NW-2 main door, 1RM17 bathroom, 4SW-2 main door and bathroom, CLC-4 main doors and bathroom and reinforce bariatric ceilings to comply with seismic structure requirements rooms ceiling and to meet fire and safety codes and American Disability Act to avoid potential fire and safety hazards at Jerry L. Pettis Memorial Veterans Medical Center, Loma Linda, California. Time is crucial to safeguard the well being and health of critical V.A. patients. American Veteran Inc is a new Woman Owned and SDVOSB. This opportunity will give them an ability to expand their business and the VA to bring in a new Woman Owned and SDVOSB into the list of construction contractors. This procurement is an emergency order that requires expedition because of danger to the health and well being of V.A. critical patients. 10. List Any Other Sources That Expressed Interest in Writing? As of this date no inquiries have been expressed in writing for this project. 11. A Statement of the Actions, if any, the Agency May Take To Remove of Overcome Any Barriers to Competition Before Any Subsequent Acquisition is required: This is an urgent and compelling requirement due to pending dangers to patient safety.
