Description
VETERANS AFFAIRS MEDICAL CETER JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-2, Pursuant to 41 U.S.C. 253(c)(5) 1. The VA Long Beach Network 22 Contracting Activity Logistics Office, 5901 East Seventh Street, Long Beach, California, intends to enter into a Contract that will require justification for other than full and open competition. This VA Greater Los Angeles, Healthcare System has a requirement for B401 CSI Mental Health Building Parking and Site Improvement , Los Angeles, California 2. This is a request for approval to issue a Sole Source contract to a Service-Disabled Veteran-Owned Small Business (SDVOSB) under the provisions of Public Law 109-461. 3. Contractor to furnish all labor, material, equipment and tools necessary to design-build services for parking lot and sight improvements between Building 500 (the main hospital and building 401 (CSI Mental Health Building). The estimated value of this contract is between $25,000.00 to $100,000.00. 4. The contract shall be issued under the authority of 41 U.S.C. 253(c) (5) permitting other than full and open competition, and per FAR Subpart 6.3, paragraph 6.302-5, Authorized or Required by Statute. In accordance with FAR 6.302 Circumstances Permitting Other than Full and Open Competition this statutory authority is cited as justification to award a sole source Service Disabled Veteran Owned Small Business contract valued more than $25,000 (simplified acquisition threshold) and less than $5,000,000 (authority ceiling limit). 5. This action requires the use of the cited authority in meeting the socio-economic goals established for the Department of Veterans Affairs. The proposed contractor (Morse & Boston Construction, Inc) meets the statutory criteria, and is registered and listed in the VetBiz registry as a SDVOSB contractor. 6. Competition was not sought for this acquisition. Pursuant to 41 U.S.C. 253(c)(5) a sole-source set-aside is authorized for acquisitions for an amount more than the Simplified Acquisition Threshold but not exceeding $5,000,000. 7. The anticipated cost will be fair and reasonable to the government based on using service estimate. 8. In an effort to support VA s socio-economic goals, the undersigned conducted market surveys (via both VetBiz.com and the Central Contractor Registration web sites) for qualified SDVOSB enterprises. The contracting officer has validated that the contractor is registered and certified in the VA VetBiz.gov database and qualifies as small in accordance with federal small business size standards for the applicable North American Industry Classification System (NAICS) code assigned to the procurement. All actions considered, no further effort was made to seek additional sources. 9. The subject project was solicited and negotiated with the contractor in Fiscal Year 2010. The best and final price was reached through a series of cost negotiations and was ultimately determined to be fair and reasonable. It is in the best interest of the patients, staffs and government to install a pathway for V.A. patients traveling from Building 500 to Building 401. The existing pathway has created unsafe and hazardous conditions for patients. The sidewalk on the west side of Building 500 has a height of more than 9 inches, and broken pavement that contributes to unsafe conditions. The existing pathway exposes patients to tripping hazards or severe fallings that can occur at any time. Time is crucial to safeguard the well being and health of critical V.A. patients and ensure safe travel to Building 401. Morse & Boston Construction Inc is a new Service Disabled Veteran Owned Small Business. This opportunity will give them an opportunity to expand their business and the VA to bring in a new SDVOSB into the list of construction contractors. This procurement is an emergency order that requires expedition because of danger to the health and well being of V.A. critical patients.
