Description
SECTION B DESCRIPTION/SPECIFICATIONS/STATEMENTOFWORK B.1. ADHC will be furnished to beneficiaries for whom such care is specifically authorized by the Department of Veterans Affairs. It is understood that the type of patient to be cared for under this contract will receive these services as a substitute for institutionalization. The purposes of providing ADHC are to enable functionally impaired individuals to reside in supportive home environments rather than in ADHC care facilities; to facilitate the return of older veterans to their home and coordinate long term care there by reducing readmission ™s to hospitals and ADHC; to maintain the older veteran at the highest level of functioning possible; to improve the quality of life for the participants among their peers; and to provide support for the family and other care givers of older veterans. The care provided will include: physician services, nursing, social work services, occupational or physical therapy, assistance with activities of daily living, activity therapy, case management, and nutrition service including meals. The ADHC Program will meet the VA standards for ADHC as promulgated in 38 CFR Part 17.51c through 17.51e. a. Unless specifically excluded in this contract, the per diem rate established will include the services listed above and will also include all services or supplies normally provided other patients by the facility without extra charge. b. If the VA and the ADHC Program agree that the VA shall provide services under 38 CFR 17.51f, the agreement will be incorporated into the contract and either the per diem rate will be re-established, or direct payment made to the United States to reflect the full cost of the VA's contribution. B.2. Full attention shall be given to motivating and educating patients to achieve and maintain independence in the activities of daily living. Every effort shall be made to keep patients ambulatory and to achieve an optimal level of self-care. B.3. Absences of the patient from the ADHC Program in excess of 48 hours will not be reimbursable except with prior approval of the placing VA facility. B.4. Patients receiving care under this contract, who begin to require more than the level of care authorized by VA, will be readmitted to an appropriate VA facility, as determined and authorized by VA. When such admission is not feasible because of the nature of the emergency, it is agreed that hospitalization in a non-Federal facility may be accomplished provided VA authorization is obtained. VA authorization must be obtained within 72 hours of admission of the patient to a non-Federal facility. If hospitalization of a non-emergency nature is required, it is agreed that readmission to a VA will be accomplished as soon as the patient ™s condition is sufficiently stabilized to permit admission to VA. B.5. In the event a VA beneficiary receiving ADHC care under this contract dies, the ADHC will promptly notify the VA office authorizing admission and immediately assemble, inventory, and safeguard the patient ™s personal effects. The funds, deposits, and effects left by VA patients upon the premises of the ADHC shall be delivered by the ADHC to the person or persons entitled thereto under the laws currently governing the ADHC for making disposition of funds and effects left by patients, unless the beneficiary died without leaving a will, heirs or next of kin capable of inheriting. When disposition has been made, the itemized inventory with a notation as to the disposition of the funds and effects will be immediately forwarded to the VA office authorizing admission. Should a deceased patient have no will, heirs, or next of kin, his/her personal property and funds wherever located vests in and becomes the property of the United States in trust. In these cases the ADHC will forward inventory of any such property and funds in its possession to the VA office authorizing admission, and will hold them (except articles of clothing necessary for proper burial) under safeguard until instructions are received from VA concerning disposition. B.6. The ADHC Program shall not maintain nor provide dual or segregated patient facilities which are segregated on the basis of race, creed, color or national origin. The ADHC Program shall neither require such segregated use by written or oral policies nor tolerate such use by local custom. The term "facilities" shall include but not be limited to rooms, wards, sections, eating areas, drinking fountains, and entrances, and other like areas. It is agreed that VA will have the right to inspection of the ADHC and all appurtenances by authorized VA representative(s) to ensure that acceptable standards are maintained and that the necessary care to maintain the well being of the patient is rendered. B.7. The ADHC shall accept referral of and shall provide all services specified in this contract for any person determined eligible by the Adult Day Care Coordinator or his/her designee, regardless of the race, color, religion, sex or national origin of the person for whom such services are ordered. In addition, the ADHC Program warrants that subcontracting will not be resorted to as a means of circumventing this provision. B.8. It is agreed that duly authorized representatives of VA will provide follow-up supervision visits to veterans placed to assure the continuity of care and to assist in the veteran ™s transition back to the community. It is understood that these visits do not substitute for nor relieve the ADHC in any way of the responsibility for the daily care and medical treatment of the veteran. B.9. All medical records concerning the veteran's care in the ADHC will be readily accessible to VA. Upon discharge or death of the patient, medical records will be retained by the ADHC for a period of at least three years following termination of care. Patient records will be maintained in conformance with the Privacy Act of 1974 (5 U.S.C. 552a). A medical record shall be maintained for each patient. B.10. The beneficiary will be provided ADHC at the expense of VA for a period not in excess of that stated in the treatment plan received from VA, unless an extension of the authorization is provided in writing by the placing VA facility. B.11. It is agreed that the ADHC Program will submit a report each month on the attendance, medical, functional and psychosocial status of beneficiaries receiving care under the contract to the VA along with a monthly invoice for beneficiaries receiving care under the contract. B.12. The contract home is required to notify the VA Medical Center if a veteran on a VA contract incurs a sentinel event and/or adverse patient reaction. This may include but are not limited to the following: 1) fall resulting in death or injury; 2) elopement resulting in a missing patient; 3) patient abuse confirmed or under investigation; 4) medication error resulting in patient illness/injury; 5) death or injury secondary to restraint usage; 6) and a patient death related to unconfirmed or suspicious nature.
