Description
Wage Determinations for State of Montana. B.1 PRICE SCHEDULE - IT Security and IT Compliance Work This procurement is conducted pursuant to the authority of Federal Acquisition Regulation (FAR) Part 13, Simplified Acquisition Procedures, and FAR Subpart 37.6, Performance-Based Acquisition. The Billings Area Indian Health Service (IHS) intends to award a fixed-price, performance-based, purchase order in response to Request for Quotation (RFQ)-10-11-009-KN. The solicitation is restricted to 100% Small Business concerns. The solicitation documents and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-41. The associated North American Industry Classification System code is 561320 and the small business size standard is $13.5 million. Unit of Item Description Quantity Issue Unit Price Total Amount 1. IT Security and 1500 HR $ $ IT Compliance Work B.2 PERIOD OF PERFORMANCE Performance of this purchase order shall be from November 1, 2010, through October 31, 2010. B.3 PURPOSE OF THE CONTRACT The purpose of this acquisition is to hire a contractor to assist in the daily work objectives of the department/program at the Billings Area, Indian Health Service, in Billings, MT. B.4 WORK SCHEDULE Monday thru Friday, Part-Time. B.5 INTRODUCTION The position is responsible for performing work which involves the enforcement, maintenance, reporting, and enhancement of the Billings Area, Indian Health Service Automated Information Systems security. B.6 STATEMENT OF WORK Ensure deadlines are met with the on-line security for FY 2011; Revise the COOP for Crow Agency; Analyze and update COOP for the rest of the IHS facilities. Work on the PIV-card system (order equipment for Area). Set up contact and report on getting the Power analyzed in all Facilities Computer Rooms. Work with Engineers if necessary. Other IT/Security tasks as needed. B.7 KNOWLEDGE REQUIRED BY THE POSITION FISMA requirements, RPMS, IHS ITAC system, Access. B.8 SCOPE AND EFFECT The purpose of this position is to carry out vital projects that are crucial to the mission of securing the Billings Area Indian Health Service IT systems and network. The work involves complying with, monitoring compliance and facilitating compliance with the HHS and IHS security policies. The scope of work involves all equipment attached to the IHS network throughout the Billings Area (including all facilities). B.9 PERSONAL CONTACTS Contacts are with all levels of personnel in all facilities and programs within IHS, Tribal, and Urban organizations and with outside vendors. B.10 PURPOSE OF CONTACTS To receive and disseminate information pertaining to Automated Information Systems security and to monitor and evaluate these items. Contacts are made with some vendors. B.11 PHYSICAL DEMANDS Physical demands are limited to desk work and limited stooping or lifting. Due to the nature of the assignment, the incumbent must also posses emotional and mental stability. Work may involve some travel and person may be required to operate a government-owned vehicle. B.12 WORK ENVIRONMENT The work is performed in an office setting which is adequately lighted, heated, and ventilated. B.13 SUPERVISION The supervisor defines the continuing assignment with procedures and methods to be used, priorities and deadlines. The supervisor helps the contractor with difficult or controversial aspects of the job requirement. The contractor uses initiative in planning and carrying out the day-to-day workload. Final work is reviewed, as needed, for conformance to policies and regulations, timeliness and satisfaction of the supervisor. The following IHS employees will assist the project officer in monitoring the contract and will be a designated as an alternate in absence of the supervisor. The responsibility of the Indian Health Service is to supervise, monitor and ensure that the contractor is adequately performing the requested services, deliverables, duties and responsibilities in accordance with the Statement of Work and performance standards for which they were hired to accomplish. SUPERVISOR: Arlene Hansen ALTERNATE: Ryan Macdonald B.14 GUIDELINES IHS Automated Security Policy and Guidelines; Federal Regulations; HIPAA; Privacy Act of 1974; Computer Security Act of 1987; FISMA; NIST. B.15 COMPLEXITY Is responsible for performing work which involves the enforcement, maintenance, reporting, and enhancement of the Billings Area Automated Information Systems security. B.16 GOVERNMENT FURNISHED PROPERTY The department shall provide the contractor with office space including a desk, chair and office supplies. The contractor will be authorized to use all areas of the facility made available to them. The contractor must request clearance in order to access restricted areas of the facility, authorization must be granted and is to be used only for official business activities relating to job performance. The contractor will be authorized to use administrative and professional support personnel in carrying out their assigned duties and objectives. The contractor will be allowed to utilize copy machines, facsimile machines, libraries and telephone services and should only be utilized for official business activities relating to job performance. The contractor shall be given an orientation to the IHS role and the Indian community that is being served. The Purchasing Agent/Supply Technician shall provide the contractor with an initial orientation regarding all aspects that pertain to their employment as a personal service contract employee, the layout of the facility and information on the role IHS has on the Indian communities being served. All Child Care National Agency Check and Investigation (CNACI) Forms will be provided by IHS. The department will orientate the contractor as to their specific duties and responsibilities. The department will provide the contractor with standard and specialized equipment and supplies needed for the performance and delivery of services including the use of a computer. The department is responsible for getting the contractor access and clearances to all pertinent ARMS; intranet; internet; and computer services that are applicable to the contractor carrying out their duties. The department must provide the contractor with direction and proper workloads, which are appropriate with the normal day-to-day operations in the department. B.17 COMPUTER SECURITY Pursuant to the Federal Information Security Management Act of 2002 (FISMA), the contractor will be required to complete a course in Computer Security Awareness Training (CSAT). This training must be completed annually by all employees including all contractors, volunteers, students, and summer externs. The Contractor will be required to comply with the Federal Information Processing Standards Publication (FIPS PUB) Number 201, "Personal Identity Verification of Federal Employees and Contractors" and the associated Office of Management and Budget (OMB) implementation guidance for personal identity verification for all affected contractor and subcontractor personnel. B.18 CONTRACTING OFFICER AUTHORITY Authority to negotiate changes in terms, conditions, or amounts cited in this contract is reserved to the Contracting Officer. B.19 PROJECT OFFICER DESIGNATION The project officer shall be responsible for: (1) Monitoring the Contractors technical progress, including surveillance and assessment of performance and recommending technical changes; (2) Interpreting the Statement of Work; (3) Technical evaluation as required; (4) Technical inspections and acceptance; and (5) Assisting the Contractor in the resolution of technical problems encountered during performance of this contract. B.20 INVOICE SUBMISSION AND PAYMENT a. The Contractor shall submit its invoice to the Project Officer. Dates of Service including the number of hours worked; and 6. Remit to address. Payment shall be made by the Billings Area Financial Management Branch, P.O. Box 36600, Billings, Montana 59107. B.21 REPORTING REQUIREMENTS The Contractor shall provide the Contracting Officer with evidence that payment of employment taxes has been made 15 days after each quarter. B.22 PRO-CHILDREN ACT OF 1994 The Contractor certifies that it will comply with the provisions of Public Law 103-227, Pro-Children Act of 1994, which imposes restrictions on smoking where federally funded children's services are provided. B.23 CHILD CARE NATIONAL AGENCY CHECK AND INVESTIGATION (CNACI) A CNACI must be completed for all Indian Health Service (IHS) contractor personnel within the Billings Area. Public Law (P.L.) 101-630, Indian Child Protection and Family Violence Prevention Act and P.L. 101-647, Crime Control Act of 1990, require the IHS to conduct a character and criminal history background investigation on all contractors performing services in IHS facilities. The character and background investigations will be conducted by the Northern Cheyenne Service Unit. B.24 SPECIAL CONTRACT REQUIREMENTS Contractors cannot serve as expert witnesses in any suit against the Federal Government. Many of the IHS patients receiving services may only speak a native language and/or reside on a Native American Reservation, therefore, the Contractor must demonstrate sensitivity to cross-cultural and language differences. The Privacy Act of 1974 mandates that the Contractor maintain complete confidentiality of all administrative, medical and personnel records, and all other pertinent information that comes to his/her attention or knowledge. The Privacy Act carries both civil and criminal penalties for unlawful disclosure of records. Violation of such confidentiality shall be cause for adverse action. All IHS regulations and policies applicable to these Acts shall be enforced. The Contractor shall comply with IHS facility infection control and safety procedures, practices, and standards. Federal Tort Claims Act coverage for medical related claims is extended to the individual providing Physician Assistant or Family Nurse Practitioner Services. However, the services must have been performed within the scope of the personal services contract. B.26 AWARD DECISION The Government will award a purchase order, resulting from this solicitation, to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: 1. Physician Assistant or Nurse Practitioner License = 35 POINTS. Potential contractors must submit a copy of State license with the price quote. 2. Resume = 35 POINTS. Potential contractors must submit resume with price quote. 3. Past Performance = 30 POINTS. The offeror must demonstrate its record of successful performance in past contracts and/or jobs, Government and/or commercial. Each offeror will be evaluated on its performance under existing and prior contracts/jobs. The offeror must list at least three contracts/jobs and include the following information. (1) Name of Government agency/Company; (2) Contract number, if applicable; (3) Dates of Service/Employment; (4) Total contract value/Hourly wage; (5) Description of contract work/Job duties; (6) Contracting Officer/Company Manager and telephone number; (7) Program Manager and telephone number, if applicable. Technical and past performance, when combined, are considered approximately equal to cost or price. B.27 52.204-3 TAXPAYER IDENTIFICATION (OCT 1998) (a) Definitions. "Common parent," as used in this provision, means that corporate entity that owns or controls an affiliated group of corporations that files its Federal income tax returns on a consolidated basis, and of which the offeror is a member. "Taxpayer Identification Number (TIN)," as used in this provision, means the number required by the Internal Revenue Service (IRS) to be used by the offeror in reporting income tax and other returns. The TIN may be either a Social Security Number or an Employer Identification Number. (b) All offerors must submit the information required in paragraphs (d) through (f) of this provision to comply with debt collection requirements of 31 U.S.C. 7701(c) and 3325(d), reporting requirements of 26 U.S.C. 6041, 6041A, and 6050M, and implementing regulations issued by the IRS. If the resulting contract is subject to the payment reporting requirements described in Federal Acquisition Regulation (FAR) 4.904, the failure or refusal by the offeror to furnish the information may result in a 31 percent reduction of payments otherwise due under the contract. (c) The TIN may be used by the Government to collect and report on any delinquent amounts arising out of the offeror's relationship with the Government (31 U.S.C. 7701(c)(3)). If the resulting contract is subject to the payment reporting requirements described in FAR 4.904, the TIN provided hereunder may be matched with IRS records to verify the accuracy of the offeror's TIN. "Facsimile proposal," as used in this provision, means a proposal, revision or modification of a proposal, or withdrawal of a proposal that is transmitted to and received by the Government via facsimile machine. (b) Offerors may submit facsimile proposals as responses to this solicitation. Facsimile proposals are subject to the same rules as paper proposals. (c) The telephone number of receiving facsimile equipment is: (406) 247-7108 (d) If any portion of a facsimile proposal received by the Contracting Officer is unreadable to the degree that conformance to the essential requirements of the solicitation cannot be ascertained from the document- (1) The Contracting Officer immediately shall notify the offeror and permit the offeror to resubmit the proposal; (2) The method and time for resubmission shall be prescribed by the Contracting Officer after consultation with the offeror; and (3) The resubmission shall be considered as if it were received at the date and time of the original unreadable submission for the purpose of determining timeliness, provided the offeror complies with the time and format requirements for resubmission prescribed by the Contracting Officer. (e) The Government reserves the right to make award solely on the facsimile proposal. However, if requested to do so by the Contracting Officer, the apparently successful offeror promptly shall submit the complete original signed proposal.
