- The U.S Departmentof Commerce (D0C), National Oceanic and Atmospheric Administration (NOAA), National Capital Acquisition Division, Simplified Acquisition Branch intends to negotiate on a sole source baiss with Xerox Corporation, using the procedures in FAR Parts 6 and 13, to purchase the renewal of full service maintenance agreement for Xerox Color Cube Serial #BRE001096. It has been determined through market research that Xerox is the only one vendor who provides the 3-Tiered maintenance plan that enables charging based on the number of color pixels printed. The period of performance is Nov 1, 2010 to September 30,2011 (base year) with the option of three other years. The statutory authority for other than full and open competition is 41 USC253 (C) (1) as implemented by FAR 6.302-1, only one responsible source. The North American Classification Code(NAICS) for this acquistiion is 423430. This is not a solicitation for competitive quotes. However, if any other interested party believes that it can meet the requirements, it may submit a statement of capabilities, which if timely received will be considered by NOAA. The capability statement and any other information furnished must be in writing and must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the foregoing requirements. Please provide commercial and governement pricing. Responses must also be accompanied by descriptive literature,warranties, and/or other information that demonstrates that the quote meets all of the foregoing requirements. Capabilitiy statements and related materials must be emailed to patricia.asamaowei@Noaa.gov by Dec 3,2010. Award will be made using FAR 13, Simplified acquisitions procedures,current through FAC 2005-46. The determination to compete or not to compete this proposed contract based upon responses to this notice is solely within the discretion of the government.
