- By way of this Notice and in accordance with the provisions of FAR 6.302-2, the Chicago District, US Army Corps of Engineers, announces its intention to award a sole source contract to Smith Root Incorporated (SRI) of Vancouver, Washington, for the purpose of acquiring a permanent EMF Shield System for the Dispersal Barrier IIA and the Demo Barrier at the Chicago Sanitary and Ship Canal Aquatic Nuisance Species Electric Dispersal Barrier Project Site in Romeoville, Illinois. The work will involve the configuration, testing and installation of an EMF shielding system that will lower measured EMF emissions to not more than 100% of the International Commission on Non-Ionizing Radiation Protection (ICNRIP) exposure standard at a distance of 12 inches from the raceway bus bars under conditions where the pulsers are operating at maximum anticipated current flow (Approximately 8500A). This Shielding system must be easily disassembled to allow for barrier maintenance and retain shielding capabilities upon reassembly and the installation of the shielding system must be performed while the Demonstration and 2A Barriers are in inoper able (shutdown) mode during the Winter maintenance period. Under a previously awarded sole source contract to SRI, this District acquired the supply and installation of pulse generator devices, which were customized and considered the only ones of its type capable of meeting the demands of the Dispersal Barrier technology. All intellectual property rights pertaining to these unique components belong exclusively to SRI, including, but not limited to copyrights, patents and trademarks which are expressly reserved to SRI and covered by their Patent 4750451. Further, SRI has research, proprietary arts, trade secret technology not open to the public that they use in fish barrier designs and components therein; thereby making SRI the only source capable of satisfying the government's requirements of this proposed contract. SRI has the technical expertise and intimate knowledge required to successfully configure an EMF Shielding System for the Dispersal Barrier IIA and the Demo Barrier, as it possesses the knowledge/technology necessary to detect possible changes in the electric engineering parameters (e.g., operating voltage and amperage, pulse width and pulse repetition frequency) for EMF dispersal barriers and resulting changes in barrier performance. In addition, it has expert knowledge of shielding systems and access to theoretical/empirical electric engineering data and related methodology to address changes to ensure proper barrier performance; it has clear and complete understanding of the requirements for shielding assembly/disassembly for proper barrier maintenance; and knowledge of the potential for heating (e.g., from eddy currents in shielding) to affect barrier performance and the resulting need for ventilation or other procedures to mitigate these possible affects. To further add, the assembly (customization) and installation of this system will require the use of SRI's uniquely skilled and highly reliable labor force, already having the immense knowledge of the Barrier's mechanical and electronic systems. This skilled labor force of SRI provided an EMF shielding for this District's Dispersal Barrier IIA Building. Its labor force demonstrated a comprehensive understanding and the capabilities necessary to properly assemble their patented components, and remain on schedule to meet the critical timeframes imposed by the tight overall project schedule. The award of this proposed fixed price services contract is critical to execute the mission for the Fish Barrier project. Therefore, the government cannot afford any delays in fulfilling the agency's requirements since the Barrier itself protects the ecosystem from two species of Asian carp. The massive and voracious fish, which can grow to 4 feet long and weigh 100 pounds, are known for their ability to leap up to 8 feet out of the water as motor boats speed by, injuring fishermen. Scientists fear that the fish, which can eat the equivalent of 40 percent of their body weight every day, could damage the ecosystem of the Great Lakes, which is the largest fresh water system on earth. I n this regard, it is deemed necessary to obtain these services from SRI to continue an agile operation of the Barrier without disruption and to avoid a substantial duplication of cost that is not expected to be recovered by way of competition. It is important to note that under the proposed contract, all work including system testing must be completed by January 21, 2011 and the O&M Manual and Management Personnel Training and Shielding System Operator's Training will be required to be completed by March 31, 2011. This notice does not constitute a solicitation for offers, proposals, etc. However, interested firms may send a capabilities statement NO LATER THAN 4:00 p.m. CDT on December 9, 2010.
