- RECOVERY PWR ARRA JODA PMIS 146613 For Information Only - Notice of Intent to Award Sole Source Modification to Contract C9325100002, JODA Zero Energy House, John Day Fossil Beds National Monument. RECOVERY TAS::14 1041::TAS RECOVERY JODA PMIS 146613 The National Park Service intends to negotiate and award a firm fixed price contract modification in the amount of $8,076.61 to Kirby Nagelhout Construction, 20635 Brinson Blvd, Bend, Oregon 97701 for additional within scope construction work at John Day Fossil Beds, near Mitchell, Oregon. This is not a request for competitive proposals and is published for the purpose of providing public notification. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION 1. Identification of the Agency and the Contracting Activity: Department of Interior, National Park Service, North Cascades National Park. 2.Nature and/or Description of the Action Being Approved: Modification of contract C9325100002 for additional within scope work related to construction of a Zero Energy Residential Structure at John Day Fossil Beds National Monument. 3. A Description of the Supplies or Services Required to Meet the Agency's Needs, Including the Estimated Value: Modification, additional within scope work at John Day Fossil Beds National Monument; added work includes providing a perimeter foundation drain system, over excavation of slab, and upgrading the capacity of the solar hot water heat. Net increase in contract price $8,076.61 4.An Identification of the Statutory Authority Permitting Other Than Full and Open Competition: COTI 1443.6-01, as amended, DIAPR 2008-10 and FAR 6.3 5.A Demonstration That the Proposed Contractor's Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited: This is an ARRA project that was properly synopsized and awarded as a competitive contract. As a complex project to construct a house that uses zero energy (produces more then it consumes) some details of the project were field changed to improve quality of construction, reduce and/or eliminate future anticipated drainage issues related to findings during soil excavation, further reduce and or save energy, and improve livability of the employee occupied structure. The contractor (KNC Construction) was selected under this Best Value RFP due to their technical ranking, past performance record, and competitive price proposal. 6.A Description of Efforts Made to Ensure That Offers Are Solicited From as Many Potential Sources as is Practicable, Including Whether a Notice Was or Will Be Publicized as Required by FAR Subpart 5.2 and, If Not, Which Exception Under FAR 5.202 Applies: The modification was properly synopsized since this action is funded under ARRA. 7.A Determination by the Contracting Officer That the Anticipated Cost to the Government Will Be Fair and Reasonable: Pricing for the additional work has been reviewed by the Program Manager and the Contracting Officer, documentation is on file. 8.A Description of the Market Research Conducted (see FAR Part 10) and the Results or a Statement of the Reason Market Research Was Not Conducted: Market Research was conducted for the original contract. This added work is closely related to the original scope of work, it would not be practical to try and obtain a second contractor to do part of the additional work required. 9.Any Other Facts Supporting the Use of Other Than Full and Open Competition (see FAR 6.302-2 (9) (i) - (iii) for some examples): N/A 10. A Listing of the Sources, If Any, That Expressed in Writing, an Interest in the Acquisition: N/A 11. A Statement of the Actions, If Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for the Supplies or Services Required: This action was properly synopsized for the purpose of providing public notice. 12.
