- The Internal Revenue Service intends to award a Blanket Purchase Agreement (BPA) for Oracle software maintenance commercial items to Mythics, Inc. This BPA will be awarded against the vendor’s GSA FSS 70 contract. However, this intent is being posted as the vendor does not have all the required items on its GSA FSS 70 contract. The open market items will be awarded on the basis of brand name requirement (FAR 6.302-1(c)) and only one responsible source (FAR 6.302-1(a)). This BPA and subsequent delivery order will be fulfilled by the delivery of software maintenance on the current Oracle database software licenses. The brand name requirement and RFQ for the Oracle software maintenance renewal were posted on GSA’s e-buy system in accordance with FAR 8.405-6. Only one vendor, Mythics, Inc, responded to the RFQ. It was later determined (prior to award) that some of the products on the Mythics, Inc quote were no longer on its FSA FSS 70 contract due to the age of the products. Oracle, the manufacturer, sent notice to the Contracting Officer on November 22, 2010 that Oracle’s Technical Support Policy (TSP) and GSA T&Cs prohibit the “breaking apart” of the licenses that were originally ordered together (a license set). Oracle’s TSP is incorporated into its GSA FSS 70 contract per Section 3 Part 4a of the GSA T&Cs. Oracle requires that the entire license set be renewed at the same time or Oracle would have to reprice the support. Breaking apart the license set is considered “de-supporting” and in accordance with Oracle’s GSA Terms and Conditions Section 3, Part 4 a, “An ordering activity may de-support a subset of licenses in a license set only if the ordering activity agrees to terminate that subset of licenses.” The IRS still requires the use of the open market items and therefore the subset of licenses can not be terminated. As database software Oracle has been approved as the standard for Tier 2 Unix database processing for over 10 years. Oracle is the only original equipment manufacturer that fulfills the IRS needs. The Government has determined that only Oracle Software and Oracle Maintenance products will meet the Government’s needs as only Oracle products are compatible with the current Oracle products. Interested parties that are able to provide the required products must clearly state their capabilities and experience in writing. Proposals must include price, terms, conditions and point of contact – name, telephone number, email address and fax number, government contact number (if applicable), performance period, business size, payment terms, tax payer identification number, and Bradstreet number.
