Description
Justification and Approval (J&A) For Other than Full and Open Competition VA Palo Alto Health Care System 3801 Miranda Avenue Palo Alto, California 94304 Subject: Sole Source Procurement - MRI Scanner Repair for VA Palo Alto Health Care System; RFP VA-261-11-RP-0971 1. CONTRACTING AGENCY: Department of Veterans Affairs VISN 21 Consolidated Contracting Activity (CCA) is responsible for the contracting action as described herein and will enter into a contract that requires justification for other than full and open competition. The solicitation number is VA-261-11-RP-0971. 2. DESCRIPTION OF ACTION: The request is being procured exclusive of competition, for a specific vendor, on a sole source basis. The award has been made to General Electric Company, DBA GE, 3000 N. Grandview Blvd W-443, Waukesha, WI 53188 as a firm fixed price contract. 3. DESCRIPTION OF SUPPLIES/SERVICES: Summary of Requirements: Contractor will troubleshoot, repair and replace defective components for the GE 1.5 T MRI Scanner located at VA Palo Alto. Estimated value of VISN 21 requirement is $35,000.00. 4. AUTHORITY CITED: FAR 6.302-2 - Unusual and compelling urgency. 5. REASON FOR AUTHORITY CITED: The service is being procured pursuant to FAR 6.302-2, to perform an emergency weekend repair of the MRI Scanner to preclude a negative impact on patient care. General Electric Company has the necessary proprietary diagnostic software capabilities and expertise to quickly diagnose and restore the unit to its full diagnostic imaging capacity. 6. EFFORTS TO OBTAIN COMPETITION: Competition was not considered due to the urgent need to have the scanner operational to avoid any interruptions and scheduling delays with veterans' services. It was determined to be in the Government's best interest to make an award to General Electric Company. 7. FAIR AND REASONABLE PRICE DETERMINATION: A Price Negotiation Memorandum (PNM) will detail how the price was determined to be fair and reasonable. 8. MARKET SURVEY/RESEARCH: GE Healthcare is the manufacturer of the MRI Scanner and has the technical expertise, experience and capabilities to promptly diagnose and repair the equipment. 9. OTHER FACTORS: This requirement will be awarded to a large business and will be accompanied by VA Form 2268 for Small Business Review. 10. INTERESTED SOURCES: The contracting officer has made a determination to issue a sole source award to General Electric Company. 11. AGENCY ACTIONS TO INCREASE COMPETITION: Due to the circumstances described in #6 and #9, no competition will apply to this action. 12.
