- The purpose of this public announcement is to inform industry of the FAA's intent to award a single source contract in accordance with AMS 3.2.2.4 to CAE, Inc., 2351 Alfred Nobel Blvd., Saint-Laurent, Quebec, Canada. The potential five-year Indefinite Delivery Indefinite Quantity (IDIQ) contract will provide support for technical refresh initiatives for the Airbus 330/340 and B737-800 Level D Simulators on as ordered basis in accordance with the attached Draft Statement of Work (SOW). The estimated value is between $6,000,000.00 to $8,000,000.00. The FAA has determined that only CAE can meet this requirement at this time for the following reasons: Specialized Expertise: CAE, Inc. is the manufacturer that developed and built both the B737-800 and Airbus 330/340 simulators. This vendor is in the unique position of being able to provide hardware and software upgrades to its simulators in an efficient and cost effective manner. If this particular vendor is not selected, significant aerospace testing research delays and system uncertainty will be incurred while vetting another vendor whose upgrade may or may not meet the FAA research requirements. Thus, the FAA may incur costly delays critical to FAA research supporting NextGen activities. These costly delays will result in an undetermined dollar impact to the industry, aerospace infrastructure, and the FAA. Proprietary Data: This vendor has developed proprietary software, data, and information (publications or documentation) at its own expense that remain the property of CAE. The FAA has limited rights to this software, data, and information specified in the current contracts Rights in Data clauses. In order to install an upgrade or enhancement, a potential contractor would require access to this CAE proprietary software, data and information. Under contract DTFAAC-07-C-00025, paragraph G.10 entitled "License to Use CAE Proprietary Software and Information", the FAA can only provide this proprietary software, data and information to a third party for research and development purposes only, and on the condition that the third party shall not be a competitor or potential competitor of CAE. Although the FAA has determined that this is a single source award based on the specifics above, we want to provide vendors an opportunity to respond to this announcement. Any information received in response to this public announcement will be used for informational purposes only and will not be released. Any proprietary information submitted will be protected if appropriately marked. Vendor participation in any informational session is not a promise of future business with the FAA.
