- Bill of Materials-Argent Software Sole Source Justification Notice of Intent to Award Argent Software Licenses Contracting Office Address Department of the Air Force, Air Force Material Command, ASC-Aeronautical Systems Center, 2275 D Street, Wright Patterson AFB, OH. 45433-7228 Description Air Force Material Command, Aeronautical Systems Center, Wright Patterson AFB OH, intends to negotiate a sole source, Firm Fixed Price contract for Argent Guardian, Predictor, and Data Consolidator Software Licenses prepared in accordance with the format in Subpart 15.2 as supplemented with additional information included in this notice. The contract will be awarded to ArgSoft Group LLC, 75 Rockfellow Plaza, New York, NY 10019-6932. Market research was previously conducted and it has been determined this is a sole source requirement IAW FAR 6.302-1. This is not a request for competitive proposals and no solicitation is available. All interested sources must respond in writing with clear and convincing evidence to support their ability to provide timely and effective services within five (5) days of this publication. A determination by the Government, not to compete this action based upon responses received, is solely within the discretion of the Government. Line Items are as follows: CLIN 0001 1 Lot-Argent Guardian, Predictor, and Data Consolidator Licenses for Windows/Unix/Linux Delivery to: Wright Patterson AFB, OH This award notice and incorporated clauses provision are those in effect through Federal Acquisition Circular Fac 2005-46, Effective 29 Oct 2010, and class deviation 05o0001. DFARS Current to DCN 20101124 Edition. Authority: 10 U.S.C. 2304(c) (1), justification. Supplies (or services) required as available from only one sole source and no other type of supplies or services will satisfy agency requirements. The below clause is included in full text: AF 5352.201-9101 OMBUDSMAN (AUG 2005) (a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern. The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the party to another official who can resolve the concern. (b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. Consulting an ombudsman does not alter or postpone the timelines for any other processes (e.g., agency level bid protests, GAO bid protests, requests for debriefings, employee-employer actions, contests of OMB Circular A-76 competition performance decisions). (c) If resolution cannot be made by the contracting officer, concerned parties may contact the Center/MAJCOM ombudsmen, Howard E. (d) The ombudsman has no authority to render a decision that binds the agency. (e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements. Such inquiries shall be directed to the Contracting Officer. Please note if manufacturer requires a license agreement to be signed by government, the terms and conditions of that agreement are required to be in compliance with all Federal Laws, Statutes, and the Federal Acquisition Regulation. Therefore, please modify accordingly and submit with your quote. Delivery schedule is thirty (30) days after receipt of order. Delivery is FOB Destination.
