- Sole Source Synopsis: Air Force Materiel Command (AFMC), Electronic System Center (ESC)/HGGI Depot Maintenance intends to negotiate solely with NCI Information Systems, Incorporated, 2850 Presidential Drive, Suite 250, Fairborn, OH 45324 for renewal of software maintenance under the authority FAR 8.405-6, FAR 16.505(b)(2)(ii) and DFARS 208.405-70..." only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized." ESC/HGGI Depot Maintenance requires continued maintenance support on the Spectrum System Development Architecture (SSDA) software license. The SSDA software currently is maintained under an existing order. The maintenance expires on June 30, 2011. ESC/HGGI Depot Maintenance has a requirement to continue maintenance for the period July 1, 2011 through June 30, 2014.Market research has determined that maintenance support for SSDA software is proprietary to NCI Information Systems, Inc. who has no authorized resellers and is the only source that can supply the software maintenance associated with this procurement. The Government anticipates the award of a firm-fixed price purchase order. Written responses to this synopsis shall contain sufficient documentation to establish a bona fide capability to fulfill this requirement. A determination by the Government not to compete this proposed order based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for determining whether to conduct a competitive procurement. This document does not constitute a solicitation for offers. Requests for copies of a solicitation will not be honored or acknowledged. Pricing data is not requested or required. No contract award will be made based on responses received; however, this information will be assessed before a final determination is made. Respondents will not be notified of the results of any Government evaluation of submitted information. Respondents who submit proprietary data shall clearly mark the data with appropriate markings. The Government will not pay for any information submitted as a result of this synopsis. This synopsis shall not be construed as an obligation on the part of the Government to acquire any products or services. Foreign participation in this acquisition is excluded at the prime contractor level. An Ombudsman has been appointed for this acquisition. The ESC Ombudsman, located at Hanscom AFB, MA, serves as the Ombudsman for all of ESC, including its GSUs. The Ombudsman hears concerns about specific issues in acquisitions, communicates those concerns to ESC/CC, ESC's Deputy for Acquisition (DC(A)) or ESC's Deputy for Support (DC(S)) from industry or Government personnel, and assists in the resolution of those concerns. The Ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes, nor does the Ombudsman diminish the authority of the program manager, contracting officer, or source selection official. When approached with an issue or query the Ombudsman independently assesses the situation and provides a response or initiates a resolution, and when requested, will maintain confidentiality as to the source of the inquiry.
