- DRAFT PERFORMANCE WORK STATEMENT (PWS) ATTACHMENT TWO (2) DISPARITY STUDY LETTER RFI ATTACHMENT ONE (1) This is a Request for Information (RFI) for commercial services reference number 01042011 issued on 4 January 2011 prepared in accordance with the format in the Federal Acquisition Regulation (FAR) Subpart 12.6 and 15.209(c), as supplemented with additional information included in this RFI and attachments one and two. This announcement constitutes the only RFI being requested and an additional written RFQ/RFP is not being issued at this time. This RFI is being issued as a Request for Information (RFI) only and the Government does not intend to award a contract on the basis of this RFI or to otherwise pay for the information solicited using Simplified Acquisition Procedures under the test program for certain commercial items found at FAR Part 13.5. Although "proposal" and "offeror" are used in this Request for Information, your response will be treated as information only. It shall not be used as a proposal. This RFI document and incorporated provisions and clauses are those in effect in the current Federal Acquisition Regulation (FAR) FAC 2005-47 and Transportation Acquisition Regulation (TAM) Supplement TAC 06-01. The NAICS code is 541611, Administrative Management and General Management Consulting Services and the small business size standard is up to $7.0 million dollars. The Department of Transportation (DOT), Federal Railroad Administration (FRA), Office of Acquisition and Grant Services have a requirement for a Rail Contracting Disparity Study in support of the requirement for a Congressional Study in accordance with the attached draft performance work statement. Support shall be accomplished at the contractors' location and submitted to the DOT/FRA Office of Acquisition. The period of performance is to be determined at a later date. FOB point is Destination. Inspection and Acceptance shall be at Destination by the Government. The following provisions and clauses apply to this acquisition: The provision at FAR 52.212-1, Instructions to Offerors--Commercial Items. Offers shall be evaluated on a technically (capability of the item/service offered to meet the agency need), price and past performance. Each offeror is to provide three references, inclusive of telephone numbers and E-mail address with their offer. The clause at 52.212-2 Evaluation of Commercial Items, provision at FAR 52.212-3, Offeror Representations and Certifications -- Commercial Items, and the Offeror must ensure a completed ORCA is available for download. The clause at FAR 52.212-4, Contract Terms and Conditions-Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders--Commercial Items. Specifically, the following clauses cited are applicable to this solicitation: 52.215-3, Request for Information or Solicitation for Planning Purposes, FAR 52.222-26, Equal Opportunity; FAR 52.222-35, Affirmative Action for Disabled Veterans and Veterans of the Vietnam Era; FAR 52.222-36, Affirmative Action for Handicapped Workers; FAR 52.222-37, Employment Reports on Disabled Veterans and Veterans of the Vietnam Era, clause at FAR 52.232-33, Payment by Electronic Funds-Central Contractor Registration.
