- Pursuant to FAR Part 13.106-1, U.S. Department of Education, Office of Federal Student issued a fixed-priced award to Cogito NA located at 139 Billerica Rd. Chelmsford MA 01854-3663, for the license and maintenance support for a proprietary software product -EZ-Reorg/RTSU. Total contract value is $62,652.00. This is not a request for proposal and no solicitation exists for this requirement. A determination by the government will entertain any statement of capability that may be submitted from other sources. Responses may be sent to Dega Hussen at dega.hussen@ed.gov. 1. Contracting Activity: US Department of Education, Federal Student Aid (FSA). 2. Description of Action: This brand name justification approves the acquisition of software maintenance renewal for EZ-Reorg/RTSU software, which is currently operating on Federal Student Aid's (Debt Management Database (DCMS) and supporting systems. 3. Authority: This justification is authorized by FAR subpart 13.106-1 (b) Soliciting from a single source. 4. Description of Supplies/Services: The EZ-Reorg/RSTU software allows for the resizing of Federal Student Aid's DCMS to be performed on an offline copy of the database. After the resize is complete the product performs a "catch-up" using the before and after images of the updated production records on the Federal Student Aid database journals. The product allows the resize process to take place offline, while minimizing the down time. Maintenance is required to provide critical updates, version control and support on the server listed below. Host Name OS Processor MIPS Memory DMCS zOS IBM 2086-320 131 8 GB The government anticipates a Firm-fixed price (FFP) award to Cogito NA for a base period in the amount of $20,884.00, and (2) option periods in the amount of $20,884.00 annually. The total cost for the 3 year contract is $62,652.00. 5. Fair & Reasonable Determination Cogito NA solely provides EZ-Reorg/RTSU software maintenance support, thus limiting competition for brand name requirements. The proposed price for this year maintenance renewal was escalated 5 percent by the company. Accordingly, the pricing is determined to be fair and reasonable, based on historical pricing. 6. Market Research Conducted: Cogito NA is the sole distributor of the EZ-Reorg software and there are no resellers. Therefore, solicitation will be issued directly to this firm. 7. Efforts to Obtain Competition: In accordance with FAR 13.106-1(a)(2)(b), the Contracting Officer determined that due to the exclusive licensing agreements of the subject software, that Cogito NA is the only reasonably available source. Accordingly, an award will be issued directly to this firm and a redacted copy of this justification will be posted on FedBizOpps. Consideration will be give to all responses received.
