- DEPARTMENT OF VETERANS AFFAIRS NETWORK 22 LOGISTICS OFFICE JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION FAR 6.302-1, 41 U.S.C. 253 (c) (1) 1. Agency and Contracting Activity Identification: The VA Long Beach Network 22 Logistics Office, 5901 E. 7th Street, Long Beach, California, as directed by the VA Southern Nevada Healthcare System will enter into a Purchase Order that requires justification for other than full and open competition. 2. Nature of Acquisition Being Approved: Bard Iodine 125 Radiation seeds for Brachytherapy procedures. 3. Description of Requirement: The awarded contractor is to provide Bard Iodine 125 Radiation seeds, as needed for Brachytherapy procedures. The period of performance is January 13, 2011, through 09/30/2011. The estimated cost is $150,000.00. 4. Statutory Authority Permitting Other Than Full and Open Competition: The services are being procured under the authority of 41 U.S.C. (c) (2), FAR Part 6.302-1(a). 5. The Nature of the Acquisition Requires Use of the Authority Cited: The VA Urologist is a certified in delivering PRO-SEED Bard Iodine 125 seeds. The oncologist is also a certified to deliver PRO-SEED Bard Iodine 125 seeds. Seeds must be a prescription dose of no less than 160 Gy. The PRO-SEED technique is the method approved by VA Urology, VASNHS. Therefore, only by one responsible source can provide the services. The acquisition falls under FAR 6.302-1, Only one Responsible Source. 6. A Description of Efforts Made to Ensure That Offers From as Many Potential Sources As Practicable and Whether a Notice Will Be Publicized. See number 5 above. A notice has been publicized for this procurement. 7. Anticipated Cost: The anticipated cost should be fair and reasonable to the government based on the using service estimate and past prices paid for similar services. 8. Results of Market Survey: Market research information was obtained through historical data. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition: None. See Items 5 above. 10. Any Other Interested Sources? There are no other sources that have expressed an interest to date. A Statement of the Actions, if any, the Agency May Take To Remove of Overcome Any Barriers to Competition Before Any Subsequent Acquisition is required: It is anticipated that subsequent requirements will be needed by the Government. VASNHS, Urology Department, would need to change their requirements and certifications in order to overcome the barriers. This is not anticipated. 12.
