- The US Environmental Protection Agency (EPA), Office of Air and Radiation (OAR), Office of Transportation and Air Quality (OTAQ), National Vehicle and Fuel Emissions Laboratory (NVFEL) intends to negotiate, on a sole source basis, under the authority of FAR 13.501(a)(1)(ii), with Horiba Instruments for the purchase of upgrades to existing Horiba-supplied engine emission test equipment/software and associated components to meet requirements mandated in 40 CFR Part 1065. The US EPA requires a system upgrade to proprietary Horiba ?STARS? software which controls engine emissions tests. Software and equipment upgrades will impact existing subsystem equipment purchased competitively in 2003 and 2004 which provide automated functionality for most of the common operator usages. Each subsystem (dyno control, CVS, analyzers, PM sampler) is running software to carry out its specific functions. Additionally, each subsystem can receive commands from the test cell host system (?STARS?) in order to carry out these functions as well as report data and results back to the host. All of this automated functionality is run by software which is proprietary to Horiba. The changes required by 40 CFR 1065 will require changing this software. However, any firm believing itself capable of meeting EPA?s requirement may submit technical documentation to establish the potential of complying with the specifications. Such documentation must be submitted to the point of contact within 15 days of the posting of this notice. A determination not to compete the proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered only for the purpose of determining whether to conduct a competitive procurement or to proceed on a sole source basis.
