Description
In accordance with FAR Part 10.002 on February 5, 2008 the Drug Enforcement Administration (DEA) released a Request for Information on this website. The purpose was to determine whether a competition could be utilized for the procurement of installation, removal, repair, replacement, corrective maintenance, and preventative maintenance service for DEA's Motorola based Land Mobile Radio (LMR), associated communications equipment and upgrades. Having received no response from any qualified, capable source it was determined necessary to establish a contract with Motorola U.S. Federal Government Markets Division (Motorola) for the maintenance service and associated equipment required. In accordance with FAR Part 5.2 on April 10, 2008 the DEA issued a notice of intent to notify interested parties of the DEA's intent to "negotiate, on a sole source basis, with Motorola, Inc. of Columbia, MD" for maintenance. There were no additional responses from interested parties. On January 30, 2009 the DEA awarded contract DJDEA-09-C-0007 to Motorola. The contract is a five year contract with one base year and four option years for maintenance services and equipment to support DEA's existing Motorola manufactured LMR and communications system. This posting is to provide notice of the DEA's intent to exercise remaining options under this contract for the continued maintenance services and associated equipment including radios, repeaters and trunking equipment. DEA's existing Motorola radios contain coding and feature sets that are proprietary to Motorola and are considered to be representative of "Intellectual Property" as the above software code is covered by multiple copyright restrictions. Therefore it is necessary to exercise the remaining options periods with Motorola to provide maintenance services, equipment, including the purchase of new radios, and upgrades to DEA's existing radio infrastructure. All repairs, replacements, equipment, and upgrades must be compatible with the existing LMR systems, including the Federal, State and local law enforcement agencies legacy systems, as was as P25 compliant, and only Motorola is able to provide compatible services owing to the proprietary and intellectual property concerns cited above. This notice of intent is not a request for competitive quotation; however, interested parties may identify their interest and capabilities not later than 8 February 2011, 8:00 am (Eastern) via email to troy.t.teachey@usdoj.gov. A determination not to exercise the options under this contract based on responses solely within the discretion of the Government.
