- RFQ-11-115 FAR 52.212-3 FAR 52.212-5 FAR 52.252-1 This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The Aberdeen Area Indian Health Service (IHS) intends to award a firm fixed price, non-personal service type purchase order in response to Request for Quote (RFQ) 11-115. The period of performance is May 01, 2011 through April 30, 2012. The solicitation documents are incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-49. This is a Small Business Set Aside. The associated North American Industry Classification System Code is 532291. PURPOSE OF CONTRACT: See attached Statement of Work. Located at the Pine Ridge IHS Hospital, E. Hwy. 18, Pine Ridge, South Dakota 57770. PRICE SCHEDULE: Oxygen Services and Supplies - the quoted unit pricing must be an all inclusive cost. All "inclusive cost" is defined to include travel, lodging, per diem, fringe benefits, i.e., life insurance, social security, federal, state, and local taxes, plus all other costs pertinent to the performance of this purchase order. 1. Complete the Price Schedule Attached are the Federal Acquisition Regulations (FAR) and the Health and Human Services Acquisition Regulation (HHSAR) clauses that are applicable including the following: FAR 52.212-1 - Instructions to Offerors - Commercial Items (June 2008): Quotes shall be submitted on company letterhead stationery, signed and dated; it shall include : 1. Solicitation number; 2. Closing date of February 18, 2011 at 11:00am CST 3. Name, address, telephone number of the offeror and email address of the contact person; 4. Technical description of the item/service being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary; 5. Terms of any express warranty; 6. Price and any discount; 7. "Remit to" address, if different than mailing address; 8. A completed copy of the representations and certification at FAR 52.212-3; 9. Acknowledgement of Solicitation Amendments (if any); 10. A statement specifying the extent of agremenet with all terms, conditions, and provisions, included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration. FAR 52.212-3 - Offeror Representations and Certifications - Commercial Items (October 2010): See attachment for full text and instruction for completion. FAR 52.212-4 - Contract Terms and Conditions - Commercial Items (June 2010): See attachment in by reference. FAR 52.212-5 - Contract Terms and Conditions Required to IMplement Statutes or Executive Orders - Commercial Items (December 2010): See attachment for full text. BASIS FOR AWARD: Quoters are advised that the Government will consider only price in determining award of this quote. The individual providing services under this contract, which involves regular contact with, or control over Indian Children, is subject to a Character Investigation in accordance with the "Indian Child Protection and Family Violence Prevention Act" P.L. 101-630. The contractor must perform in accordance with Section 231 of the Crime Control Act of 1990, P.L. 101-647. Failure to comply with these statutes will result in immediate removal. A Childcare National Agency Check and Inquiries (CNACI) suitability screening will be performed and cleared according to the information provided to us on the Optional Form 306. The individual performing must complete and return the following forms to the Acquisition Official as soon as possible: - OF-306 Declaration for Federal Employment - OF-306 Addendum to Declaration for Federal Employment - Agreement to a Temporary Waiver of Character Investigation The selected offeror must make arrangements with the Service Unit Background Investigation Coordinator and complete the following as soon as possible: - Fingerprints (done electronically) - SF-85 Questionnaire for Non-Sensitive Positions (done electronically) A Security Pre-Clearance must be performed for any employees referred to IHS through this purchase order. Fingerprints must be completed and adjudicated prior to services being performed under this purchase order. No contract award shall be made to any vendor or provider listed on the OIG Exclusion List http://exclusions.oig.hhs.gov throughout the duration of the contract. It shall be the responsiblity of the contractor to notify the Acquisition Official if there is a change in provider. Should the candidate be found with a non-favorable security clearance, it shall be the contractor's responsiblity to replace that candidate working under the contract with a suitable condidate.
