- DEPARTMENT OF VETERANS AFFAIRS Justification and Approval For Other Than Full and Open Competition 1.Contracting Activity : Department of Veterans Affairs, VISN 8, West Palm Beach VA Medical Center, Acquisition Service Center 7, Service Team 3. The Prosthetics Service at the Tampa VAMC has submitted 2237 # 673-11-2-910-2159, as an Emergency priority, to be processed by ASC 7 (Station 548) for the procurement of Durable Medical Equipment (DME) Services. Estimated cost: $88,000.00. 2.Nature and/or Description of the Action Being Processed: This action is for a sole source urgent and compelling requirement to provide DME services for patients of the James Haley VA Medical Center in Tampa, Florida and the surrounding area CBOC's. Veterans Medical Supply, Inc. has been providing the necessary services. There was not a lack of advanced planning for this requirement. Contract VA248-P-1419 was competitively awarded on 06/24/2010 to provide DME services. This contract was terminated for convenience on 01/14/2011 as a result of a protest filed by an unsuccessful offeror. These services are still needed and this temporary bridge contract is required to avoid a break in services while ASC 8 (Station 673) is currently working on getting a new competitive contract in place. 3.Description of Supplies/Services Required to Meet the Agency's Needs: The requirement is for the storage, delivery/install, and pick-up of VA owned Durable Medical Equipment. 4.Statutory Authority Permitting Other than Full and Open Competition: ( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1; (X) (2) Unusual and Compelling Urgency per FAR 6.302-2; ( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3; ( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5; ( ) (6) National Security per FAR 6.302-6; ( ) (7) Public Interest per FAR 6.302-7 5. Demonstration that the Contractor's Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Veterans Medical Supply currently has an entire inventory of VA-Owned DME equipment. Award to another vendor for this bridge contract would cause an unacceptable delay in services. Other capable vendors are encouraged to compete in the long-term DME contract currently being processed by ASC 8 (Station 673). 6.Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: This required action is for a bridge contract to provide services while a long-term contract is put in place. Other vendors capable of providing the required services are encouraged to compete in the long-term DME contract currently being processed. 7.Determination by the Contracting Officer that the Anticipated Cost to the Government will be Fair and Reasonable: Anticipated costs for this temporary bridge contract are considered fair and reasonable as they are the very same prices from the competitively awarded DME contract VA248-P-1419 that was terminated for convenience on 01/14/2011. 8.Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: This required action is for a bridge contract to provide services while a long-term contract is put in place. Other vendors capable of providing the required services are encouraged to compete in the long-term DME contract currently being processed. 9.Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A 10.Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: N/A 11.A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: A follow-on competitive acquisition is currently being processed.
