- Army Contracting Command-Redstone currently has requirements to procure maintenance and overhaul for the following commercial items that have been classified as Critical Safety Items: Noun / NSN/ APN / Cage Codes for approved sources 1. Conditioner Panel, 6110-01-524-8524,HM025-429-11, 02LU7 2. Clutch Assembly, 3010-01-515-8483,3617950-1, 02LU7 3. Fuel Control, 2915-01-572-1314,2524911-8, 4G088/58320/9X173 4. Turbine Rotor, 2840-01-515-3538,3048T90G01, 99207 5. T701D aircraft eng,2840-01-503-1701,5130T00G01, 062W2/3AH19/S0204 6. T700 Engine, 2840-01-070-1003,6035T00G01, 062W2/3AH19/S0204 Based on Public Law 108-136 and local regulations the following Army Contracting Command-Redstone Non Commercial clauses are required to be included in all procurements for Critical Safety Items: 1. Clause 52.209-4011 QE-STD-1 2. Clause 52.211-4002 and -4003(dictates overhaul procedures to be used)Statement of work 3. Clause 52.209-4012 QE-STD-2 4. Clause 52.209-4723 Product Verification Audit 5. 52.246-4009 Flight Safety Part Supplier Interface and Oversight Program Requirement 6. 52.209-4008 Notice to Offerors-Flight Safety parts 7. 52.209-1 Qualification Requirements 8. 52.247-4005 Statement of Work Federal Aviation Administration Airworthiness Approval 9. 52.246-4005 Verification of Continuity of Frozen Planning Army Contracting Command-Redstone currently has requirements to procure maintenance and overhaul for the following commercial items that are not Critical Safety Items: Noun/ NSN/ APN/ Approved Sources 1. Winch, Hoist, 1680-01-089-4331,42305R100, 82402/00462 2. Valve Assy,Bleed, 2840-01-191-7811,23053176, 36213/22819/63005 3. Tank Refueling, 1560-01-523-5396,HM025-410-21, 1T765 4. Combustion Chamber,2840-01-304-4302,6064T54G08, no approved souces These commercial items require the use of the following clauses: 1. 52.209-4723 Product Verification Audit 2. 52.211-4002 Statement of Work Government Standards 3. 52.211-4003 Statement of Work Contractor Standards 4. 52.247-4004 Reusable Containers FAR 12.302(c) entitled " Tailoring inconsistent with customary commercial practice" states that "The contracting officer shall not tailor any clause or otherwise include any additional terms or conditions in a solicitation or contract for commercial items in a manner that is inconsistent with customary commercial practice for the item being acquired unless a waiver is approved in accordance with agency procedures. The request for waiver must describe the customary commercial practice found in the marketplace; support the need to include a term or condition that is inconsistent with that practice and include a determination that use of the customary commercial practice is inconsistent with the needs of the Government." In accordance with this requirement this notification is being published to solict answers from the contracting community to satisfy the above stated requirement. A determination is required to address what is being done in the commercial market place and if the Government requirement is inconsistent with commercial practices. The best evidence to make this determination would be industry to advise if the activity required by the Government clauses are similar to practices included/required in the customary commercial environment. Additionally please expound on practices that you require in contracts for similar items for non-governmental customers. It need not be shown that the use of a similar clause is a common practice, but the activity required by the clause must be reflective of a common practice in the commercial market place for it to be considered customary. If there is a similar process to these clauses in the customary commercial environment, please describe the similar process being used currently in the commercial market place. You are encouraged to respond as this information will determine the future procurement process for all commercial M&0 requirements for the Army Contracting Command-Redstone.
