Description
This is a combined synopsis/solicitation for commercial itemsprepared in accordance with the format in the Federal Acquisition Regulation (FAR) Part 13.6 as supplemented with additional information in this notice. This notice constitutes the only solicitation; quotes are being requested and A WRITTEN SOLICITATION WILL NOT BE ISSUED separate from this announcement. Solicitation DE-RQ65-11WA46962 is issued as a Request for Quotation (RFQ). You may submit your written quote on company letter head or on a Standard Form 1449. The solicitation documents and incorporated provisions and clauses are those in effect through FAR Federal Acquisition Circular 2005-48. This solicitation is for full and open competition after exclusion of sources in accordance with the attached Justification for Brand Name Sources (Attachment 1). The North American Industry Classification System Code (NAICS) is 423610. Size standard is 100 employees. A firm fixed price contract will be awarded using Simplified Acquisition Procedures. The U.S. Department of Energy, Western Area Power Administration, Corporate Services office requires the purchase of CommScope/Systimax components and cables for our data center as identified below and the attached specifications CLIN 0001 CLIN 0005 Please see Attachment 2 CLIN 0006 CLIN 0023 Please see Attachment 3 CLIN 0024- Installation of patch panels and cabling IAW Statement of Work Offers will only be accepted from CommScope Systimax authorized dealers/re-sellers/ installers. A delivery date for the supplies and a period of performance for installation must be provided to be considered responsive to this Request for Quotation (RFQ) The following clauses and provisions apply to this solicitation: 52.212-1, Instructions to Offerors Commercial Items (Jun 2008). Please submit the product information, manufacturer and part number of item you will be supplying. FOB Destination to: ATTN RECEIVING Western Area Power Administration 12155 W. Alameda Pkwy. Lakewood, CO 80228-2802 52.212-2, Evaluation -- Commercial Items (Jan 2009). The Government intends to award to the responsible contractor whose quotation represents the best value to the Government, considering price and price-related factors (quoted delivery time for the items and period of performance for installation). 52.212-3, Offeror Representations and Certifications -- Commercial Items (Jan 2011). * All firms or individuals submitting a quote shall include a completed copy of this provision, or include a completed copy of the Online Representations and Certifications Application (ORCA). Contractor shall acknowledge in their quote that their ORCA (Online Representation and Certification Application) is current and up to date, located at: https://orca.bpn.gov/. If your ORCA is not current and/or you do not submit a completed copy of this provision, your quote will be considered non-responsive. 52.212-4, Contract Terms and Conditions -- Commercial Items (Jun 2010) 52.222-48 -- Exemption from Application of the Service Contract Act to Contracts for Maintenance, Calibration, or Repair of Certain Equipment Certification (Feb 2009) (a) The offeror shall check the following certification: CERTIFICATION The offeror [ ] does [ ] does not certify that (1) The items of equipment to be serviced under this contract are used regularly for other than Government purposes, and are sold or traded by the offeror (or subcontractor in the case of an exempt subcontractor) in substantial quantities to the general public in the course of normal business operations; (2) The services will be furnished at prices which are, or are based on, established catalog or market prices for the maintenance, calibration, or repair of equipment. (i) An established catalog price is a price included in a catalog, price list, schedule, or other form that is regularly maintained by the manufacturer or the offeror, is either published or otherwise available for inspection by customers, and states prices at which sales currently, or were last, made to a significant number of buyers constituting the general public. (ii) An established market price is a current price, established in the usual course of trade between buyers and sellers free to bargain, which can be substantiated from sources independent of the manufacturer or offeror; and (3) The compensation (wage and fringe benefits) plan for all service employees performing work under the contract are the same as that used for these employees and equivalent employees servicing the same equipment of commercial customers. (b) Certification by the offeror as to its compliance with respect to the contract also constitutes its certification as to compliance by its subcontractor if it subcontracts out the exempt services. If the offeror certifies to the conditions in paragraph (a) of this provision, and the Contracting Officer determines in accordance with FAR 22.1003-4(c)(3) that the Service Contract Act (1) Will not apply to this offeror, then the Service Contract Act of 1965 clause in this solicitation will not be included in any resultant contract to this offeror; or (2) Will apply to this offeror, then the clause at 52.222-51, Exemption from Application of the Service Contract Act to Contracts for Maintenance, Calibration, or Repair of Certain Equipment--Requirements, in this solicitation will not be included in any resultant contract awarded to this offeror, and the offeror may be provided an opportunity to submit a new offer on that basis. (c) If the offeror does not certify to the conditions in paragraph (a) of this provision (1) The clause in this solicitation at 52.222-51, Exemption from Application of the Service Contract Act to Contracts for Maintenance, Calibration, or Repair of Certain Equipment--Requirements, will not be included in any resultant contract awarded to this offeror; and (2) The offeror shall notify the Contracting Officer as soon as possible, if the Contracting Officer did not attach a Service Contract Act wage determination to the solicitation. (d) The Contracting Officer may not make an award to the offeror, if the offeror fails to execute the certification in paragraph (a) of this provision or to contact the Contracting Officer as required in paragraph (c) of this provision. WES-H-1054 Compliance with Internet IPV6 Protocol (WAPA, DEC 2005) a. This contract involves the acquisition of Information Technology (IT) that uses Internet Protocol (IP) technology. The contractor agrees that: (1) all deliverables that involve IT that uses IP (products, services, software, etc.) will comply with IPv6 standards and interoperate with both IPv6 and IPv4 systems and products; and (2) it has IPv6 technical support for development and implementation and fielded product management available. b. If the contractor plans to offer a deliverable that involves IT that is not initially compliant, the contractor agrees to: (1) obtain the Contracting Officers approval before starting work on the deliverable; (2) provide a migration path and firm commitment to upgrade to IPv6 for all application and product features by June 2008; and (3) have IPv6 technical support for development and implementation and fielded product management available. c.
