- Solicitation DISA/DITCO, intends to issue a sole source contract to Business Software, Inc., 155 Technology Parkway, Suite 100, Norcross, GA 30092. This acquisition is for maintenance of Business Software TaxFactory software covering 1,498,602 employees. The software being maintained is proprietary and protected by copyright laws. No third party maintenance is authorized. Period of performance is 01 Apr 2011 through 31 Mar 2012. The statutory authority for other than full and open competition is 10 USC 2304( c)(1), only one responsible source and no other supplies or services will satisfy agency requirements. Companies who can provide the above listed software maintenance renewal must complete the attached solicitation, HC1028-11-T-0180, and return it via email to jason.day@disa.mil by 11:59 A.M. (Central Time) on 01 March 2011. The resultant contract will be a firm fixed price purchase order. The NAICS code is 541519 for this procurement. The justification detailing the government's essential need for Business Software TaxFactory software maintenance is listed below. The following paragraphs, IAW FAR Part 8.405-6(f), are provided to support the limited source justification for proposed orders exceeding the micro-purchase threshold, but not exceeding the simplified acquisition threshold. DISA Computing Services has a requirement to purchase Business Software TaxFactory software maintenance for DISA Mechanicsburg. The vendor owns all proprietary rights to the software's source code and is the only responsible sole source for maintenance. No other source can provide maintenance upgrades (e.g., versions and releases), correct problems (e.g., patches, fixdocs, Program Temporary Fix (PTF)), and keys/passwords (by CPU model, serial number, or time period) authorizing operation of the software. Based on the above information, competition is restricted to only one responsible source, Business Software, Inc.
