DEPARTMENT OF VETERANS AFFAIRS Justification Review Document For Other Than Full and Open Competition 1. Contracting Organization: VA Black Hills Health Care System, Fort Meade, SD 2. Description of Action: A Firm Fixed-Price contract is contemplated for acquisition of A/E design services for project 568-11-121, Quarters 144 Women Veteran Hoptel Conversion . 3. Description of Commodities: Work consists of awarding an A/E contract for design services for project 568-11-121, Quarters 144 Women Veteran Hoptel Conversion . Services include preliminary and working design drawings, construction period services, and required site visits. 4. Statutory Authority: Federal Acquisition Regulation (FAR) 6.302-5, Authorized or required by statute is being cited. Specifically, Sections 502 and 503 of Public Law (P.L.) 109-461, the Veterans Benefits, Health Care and Information Technology Act of 2006, currently implemented by Office of Acquisition and Logistics Information Letter (IL) 049-07-8, the Veterans First Contracting Program. 5. Validity of Use of Statutory Authority: The contractor, FourFront Design, Inc., is a service disabled veteran owned small business (SDVOSB). They have successfully completed numerous A/E design projects at this medical center in the last 3 years. Most of these projects were completed as task orders against a VISN 23 IDIQ A/E contract, however the IDIQ contract has expired and a new VISN 23 IDIQ A/E contract for design services is not yet in place. The facility also has contemplated utilizing a Sioux Falls VAMC IDIQ A/E contract for design services but the contract was not initially set up for multi-site use and is thus unavailable for use by this facility. The design phase for this project must be initiated as soon as possible to ensure NRM construction funds are obligated prior to the end of June to meet VA obligation deadlines. If the deadline is not met, funds may be withdrawn and this project, which is needed to support identified veteran patient needs, would be delayed or cancelled. Therefore, we are seeking approval to use FourFront Design, Inc. as a sole source contractor for the required A/E design services. 6. Sources Solicited: FourFront Design Inc. is the only registered SDVOSB A/E firm found in South Dakota when conducting market research. They have held a VISN 23 A/E IDIQ contract. They have recently completed and are currently working on several similar project designs at this facility. They have available designers and are in a position to proceed with design services as soon as given approval to proceed. No other SDVOSB sources were found during market research. 7. Market Research Conducted: The Central Contractors Registry and VetBiz were searched for available SDVOSB A/E firms in the serviceable area and only FourFront Design, Inc. was identified. Due to the urgent need to initiate a design contract for this project in order to maintain a timely schedule for the construction phase, no further market research was conducted. 8. Other Facts Supporting the Use of Other Than Full and Open Competition: Fort Meade VA has awarded several task orders to Four Front Design against a VISN 23 IDIQ A/E contract which expired at the end of FY2010. They are a local SDVOSB that has a proven track record for providing expedited construction designs for VA projects. They are familiar with VA design criteria, construction standards and the Fort Meade site. 10. Actions to remove Barriers to Competition: When the VISN 23 IDIQ A/E contract is available it is anticipated future designs will be initiated as task orders against the VISN 23 IDIQ contract. Also, VABHHCS is considering initiating local facility IDIQ contracts in the future. 11. Fair and Reasonable Price: Pricing for previous work performed by this contractor has always been in line with Government estimates. The government estimate to complete this work is $30,000. 12. Contracting Officer's Certification: Based upon the information provided herein, I believe the justification for awarding this project design to FourFront Design, Inc. on a sole-source basis is accurate and complete to the best of my knowledge and recommend we proceed as such. ________________________________________ Contracting Officerdate concur ________________________________________ Warranted One Level Above COdate
