- Notice of Intent to award sole source contract modification. The National Park Service, North Cascades National Park Service Complex, Sedro-Woolley, Washington, intends to award a sole source modification to Wesslen Construction of Spokane, Washington valued at $27,716 for additional within scope work. This is not a request for competitive proposals and is announced for the purpose of compliance with Federal Acquisition Regulations, the justification follows: 1. Identification of the Agency and the Contracting Activity: Department of Interior, National Park Service, North Cascades National Park, 810 State Route 20, Sedro-Woolley, Wa 98284. 2. Nature and/or Description of the Action Being Approved: Modification of contract C9471101055 for additional within scope work. 3. A Description of the Supplies or Services Required to Meet the Agency's Needs, Including the Estimated Value: Modification, additional within scope work at North Cascades National Park, Lake Chelan National Recreation Area, Stehekin Dock Project; added work includes; 1) installing a bubble curtain around steel piles greater than 10 inches in diameter as a sound attenuation method during pile driving with an impact hammer below the ordinary high water line, and 2) exchanging hydraulic fluid in equipment used for this project with biodegradable fluids certified as non-toxic to aquatic organisms. Net increase $27,716 (original award $982,703). 4. An Identification of the Statutory Authority Permitting Other Than Full and Open Competition: COTI 1443.06-01, as amended, DIAPR 2008-10 and FAR 6.3 5. A Demonstration That the Proposed Contractor's Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited: This was a competitive project that was properly synopsized and awarded. Wesslen Construction was selected as the Best Value in accordance with the solicitation requirements and Federal Acquisition Regulations. At time of solicitation & award, some required permits were still outstanding. Once permits were received (post award), additional mitigation provisions were required by the Washington Department of Fish & Wildlife and the U.S. Army Corps of Engineers. It would not be practical to try and obtain a competitive award to do a small part of the work of a major construction project. Stehekin, Washington is also one of the most remote locations in the lower 48 states, contractor access to Stehekin is via a 55 mile long barge trip or float plane. 6. A Description of Efforts Made to Ensure That Offers Are Solicited From as Many Potential Sources as is Practicable, Including Whether a Notice Was or Will Be Publicized as Required by FAR Subpart 5.2 and, If Not, Which Exception Under FAR 5.202 Applies: The Notice of Intent modification will be properly synopsized. 7. A Determination By the Contracting Officer That the Anticipated Cost to the Government Will Be Fair and Reasonable: Pricing for the additional work has been reviewed by the Program Manager and the Contracting Officer, documentation is on file. 8. A Description of the Market Research Conducted (see FAR Part 10) and the Results or a Statement of the Reason Market Research Was Not Conducted: Market Research was conducted for the original contract. This added work is directly related to the original scope of work, it would not be practical to try and obtain a second contractor to do a small part of the additional work required. 9. Any Other Facts Supporting the Use of Other Than Full and Open Competition (see FAR 6.302-2 (9) (i) - (iii) for some examples): N/A 10. A Listing of the Sources, If Any, That Expressed in Writing, an Interest in the Acquisition: N/A 11. A Statement of the Actions, If Any, the Agency May Take to Remove or Overcome Any Barriers to Competition Before Any Subsequent Acquisition for the Supplies or Services Required: Environmental requirements were reviewed by Program Personnel before the solicitation phase and all anticipated mitigation requirements were included. The additional mandates were not anticipated. 12. Certification: I certify that any supporting data that is the responsibility of technical or requirements personnel (i.e. verifying the Government's minimum needs or schedule requirements or other rationale for other than full and open competition) and which form a basis for the justification have been certified as complete and accurate: Signed certifications on file at NOCA procurement office.
