- Attachment B Attachment A This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This is a Request for Quote (RFQ) and the solicitation number is CFIT-11-SO-0096. This solicitation is also issues under FAR Subpart 13.5, Test Program for Certain Commercial Items. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2005-48 effective January 31, 2011. This is a brand name requirement for Microsoft and alternative products will not be considered. Award will be made on a lowest price, technically acceptable basis. The Government also reserves the right to make no award at all. Description of Requirement: This acquisition is being solicited under the terms and conditions of the Small and Independent Agency Councils (SIAC) Enterprise Agreement with Microsoft. Under this agreement, CFTC qualifies at a minimum Level D price. However, further discounts are encouraged. This acquisition is limited to authorized resellers of the Microsoft Enterprise Agreement. A list of MS products required by the solicitation is provided in Attachment A. Quotes shall include pricing for each of listed products for each year of the three-year agreement (CLIN 001, 002 and 003). CLIN 002 and 003 are options that may be exercised at the sole discretion of CFTC. Quotes shall also include pricing for true up of licenses for each year of the agreement (CLIN 004, 005 and 006). Additionally, CFTC may at its sole discretion, place orders for additional MS products with the awardee during the term (including option periods) of the agreement. The total value of the agreement, including all options and additional orders as described above, shall not exceed $5,000,000. Provisions/Clauses: The following Federal Acquisition Regulation (FAR) provisions and clauses apply to this solicitation and are incorporated by reference: FAR 52.212-4, Contract Terms and Conditions-Commercial Items; FAR 52.225-13, Restrictions on Certain Foreign Purchases; and FAR 52.232-18, Availability of Funds. The following FAR provisions and clauses are incorporated in full text (see Attachment B): FAR 52.209-7, Information Regarding Responsibility Matters; FAR 52.212-3, Offeror Representations and Certifications--Commercial Items (An offeror shall complete only paragraphs (b) of this provision if the offeror has completed the annual representation and certificates electronically at http://orca.bpn.gov); and FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders--Commercial Items. This solicitation incorporates one or more clauses by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. Also, the full text of a clause may be accessed electronically at this address: http://www.acquisition.gov/far/. Information to be provided in Quote: Quotations must include the pricing details indicated in Attachment A, either by using the Attachment A format or another format that clearly sets forth the required pricing details. Your quote must include a completed FAR 52.212-3, Offeror Representation and Certifications-Commercial Items. Your quote must also include your DUNS number, Company name and address, POC, and phone number. If you need to obtain a DUNS number, please visit www.ccr.gov. Lack of registration in the CCR database will make an offeror ineligible for award. Evaluation for Award: Award will be made on a lowest price, technically acceptable basis. Technically acceptable means that the quote complies with all requirements of this solicitation. From the standpoint of price, the Government will consider the total extended price for CLIN 001, 002, 003, 004, 005 and 006. The extended price for CLIN 004, 005 and 006 shall include the estimated true-up quantities for these CLINs shown in the attached Schedule. The quantities shown for true up are estimates only and actual quantities may be more or less than those amounts.
