- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION for modification to extend period of performance. REQUESTING AGENCY AND CONTRACTING ACTIVITY: The Division of Contracting and the General Services on behalf of the Division of Engineering plans to contract on a Sole Source basis. This document sets forth the justification and approval as required by FAR 6.303. NATURE AND/OR DESCRIPTION OF ACTION TO BE APPROVED: Justification is requested to modify the existing Indefinite Delivery/Indefinite Quantity contracts for Architect-Engineer Services Contracts to include contract 701816D041 with PDC, Inc. and 701815D042 with HDR Engineering to extend the period of performance for 6-months while the Region 7 pursues replacement contracts for this service. These contracts expire on February 28, 2010 DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED:.The 6-month period of performance extension for this indefinite quantity vehicle shall result in an increase of not more than $500,000.00 for both contracts. Historical award under these contracts include $2M in awards to HDR and $300K in awards to PDC for the 5-year period. Projects include construction and non-routine maintenance projects requiring architectural-engineering support of these contracts. Construction support for projects design by these firms will also be a requirement under the proposed contract extension. STATUTORY AUTHORITY:. Only one responsible source and no other supplies or services will satisfy agency requirements. (FAR 6.302-1) DEMONSTRATION OF REQUIREMENT OF AUTHORITY: Extension of this contract is necessary to fulfill agency needs while replacement IDIQ contracts for this service are acquired. Use of other than an IDIQ to fulfill agency needs while replacement contracts are being procured is not conducive to the mission of supporting 17 remote facilities many with deferred maintenance requirements and life safety issues. These requirements often surface unexpectedly due to subjection of facilities to regional harsh arctic and subarctic conditions. Procurement of standalone contracts for the listed requirements and unplanned actions will cause unacceptable delays in fulfilling essential services to support systems and structural issues for remote facilities. Design-build is also considered. While this procedure is a viable solution it is often not practicable for many of the small rehab project historically procured under these contracts. In addition, FWS needs the continued services of these firms for construction phase services on awarded contracts. As designers-of-record, use of these firms for follow-on engineering oversight of construction in progress is the most practical and cost effective solution. Foremost, the award of contracts with periods of performance extending beyond the implementation of the Financial Business Management System (FBMS) scheduled in the fall of 2011 is precluded due to data conversion limitations. Conversion of data is a monumental task for the agency and avoidance of conversion of long-term contracts from the existing IDEAS contract writing system to the new FBMS integrated contracting and financial system will avoid potential long term labor intensive administrative issues. Award of replacement contracts shall be consistent with FBMS implementation of November 2011. EFFORTS TO ENSURE WIDE RANGE OF OFFERS: MARKET RESEARCH: Market research shall be pursued to conduct the new procurement for these services. This modification to extend the current contract will provide the agency a contract vehicle to support mission requirements while the market research and the procurement is conducted. An announcement was posted in FBO on 23 November for a 30-day period. Responses to the announcement will be considered. OTHER SUPPORTING FACTS:Other facts supporting the use of other than full and open competition: 1.Statements of work for individual requirements listed above shall be provided consistent with normal IDIQ contract procedures and are generally developed with each Task Order request for proposal. 2. The Competitive Demonstration Act previously precluded the Government from setting aside contracts in this NAICS code; however, with the repeal of the act new opportunities for small business set asides will have a significant bearing on the procurement strategy for the replacement contracts LIST OF INTERESTED SOURCES: No firms have expressed an interest to date. STATEMENT OF ACTIONS TO INCREASE COMPETITION: The Government will take the following actions to remove or overcome barriers to competition before any subsequent acquisition for the required supplies or service:1.This non-competitive procurement shall be used as a bridge to provide time to develop competitive specifications for a future competitive procurement to be issued before March of 2011.2. The task order requirements for this IDIQ are generally for smaller projects which is conducive to small business AE firms. The specification for the replacement contracts shall allow small business firms to qualify for this multi-disciplined requirement by allowing them to use subcontractors for some disciplines. Depending on the results of market research, it is anticipated the replacement contracts for this service shall consist of multiple contracts to small business.
