- ***NOAA's Acquisition & Grants Office, Western Acquisition Division-Boulder, intends to negotiate, on a sole source basis, under authority of FAR 13.106-1(b)(1), with Fling Charters Inc. for research cruises at the Flower Garden Banks National Marine Sanctuary (FGBNMS) on an as needed basis. ***The sole source determination is based on the National Oceanic and Atmospheric Administration's (NOAA) requirement for research cruises which take place as weather permits in the Gulf of Mexico, FGBNMS area. The needed vessel must have space and berthing for up to 30 divers/researchers and participants. The vessel must also have the capability to supply Nitrox, an oxygen-enriched (up to 36% oxygen) air mixture for SCUBA diving. The use of Nitrox is necessary for diving operations at the depth and time duration needed for the research because it provides an added measure of safety. Fling Charters Inc. is the only operator with a vessel that meets all criteria. ***This notice of intent is not a request for competitive proposals and no solicitation package is available. However, firms that believe they can provide services that fully meet the Government's requirements may submit substantiating documentation in writing to the identified point of contact within 10 days after publication of this synopsis. Such documentation will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to conduct a competitive procurement, based upon responses to this notice, is solely within the discretion of the government. Oral communications are not acceptable in response to this notice.
