Description
DEPARTMENT OF VETERANS AFFAIRS Justification Review Document For Other Than Full and Open Competition 1. Contracting Organization: VA Black Hills, Fort Meade, SD 2. Description of Action: A Firm Fixed-Price contract is contemplated for acquisition of construction services for an emergency relocation of the Bldg 148 G-ward Nursing Home control door. 3. Description of Commodities: Work consists of soliciting services from North Central Supply to install a new control door and automatic door opener providing access to the Bldg 148 G-ward Nursing Home unit. The automatic door opener needs to be integrated with the relocation of an existing secure care/wanderguard system. 4. Statutory Authority: 41 U.S.C. 253 (c)(1) Only one responsible source 5. Validity of Use of Statutory Authority: The secure care /wanderguard system currently installed on the subject control door has recurring nuisance alarms and has been shut down. The VA staff have been unable to troubleshoot the problem. North Central Supply was contacted to diagnose the problem as they are the primary door hardware and metal door manufacturer in the Black Hills Region. They have completed similar work at the VA in the past as a subcontractor under competitively awarded contracts. Due to the geographic location of the Black Hills region, the source of supply for this type of service is limited. It has been our experience that soliciting for this service from general contractors results in a subcontract to North Central Supply to supply and install the door hardware. Awarding to a general contractor results in added cost to the government in the form of overhead and profit charged by the general contractor. It is in the best interest of the government to contract directly with North Central Supply, a women-owned, small business, to complete the work required. Therefore, in accordance with Federal Acquisition Regulation (FAR) 6.302-1, Statutory Authority 41 U. S. C. 253 (c)(1) is being cited. 6. Sources Solicited: North Central Supply was contacted to diagnose the problem based on our previous experience with their services and the fact that they are the primary door/door hardware supply warehouse in the local area. They are familiar with the facility, have recently completed like work, and are familiar with the necessary interfaces with the secure care system. They have diagnosed the problem, recommended a solution and are able to proceed with ordering materials and installation pending approval to proceed. 7. Market Research Conducted: Due to limited sources of supply in the geographical area, a minimal Market Survey was completed. North Central Supply is the primary door/door hardware supply warehouse in the local area and is capable of completing the work in a timely manner. North Central Supply is a women owned, small business. 8. Other Facts Supporting the Use of Other Than Full and Open Competition: The following reasons are cited for using the selected vendor, North Central Supply as a sole source vender: North Central Supply is both a hardware supplier and an installer and can supply, install and test the required door, hardware, and operators. Utilizing a general contractor in this particular case adds unnecessary delay and cost. North Central Supply has completed similar work at this location in the past as a subcontractor and has been successful in resolving similar issues as they have the technical expertise. The new door, hardware and operators are being installed in an existing frame thus most of the work will need to be customized to the existing conditions. Since North Central Supply custom manufacturers the doors, they have that capability themselves. 10. Actions to remove Barriers to Competition: Any new secure care/ wander guard door systems will when possible be evaluated for errant noise before installation. New electronic equipment will be evaluated for noise contribution and impact on secure care/wander guard equipment. 11. Fair and Reasonable Price: The quoted price of $15,516.75 is fair and reasonable as compared to the government estimate. 12. Contracting Officer's Certification: Based upon the information provided herein, I believe the justification for awarding this project to North Central Supply on a sole-source basis is accurate and complete to the best of my knowledge and recommend we proceed as such. ________________________________________ Contracting Officerdate concur ________________________________________ Warranted One Level Above COdate
