- JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION Upon the basis of the following facts other than full and open competition for the proposed contractual action is approved. Identification Number (purchase request/solicitation number) 650-11-1-886-001, as amended. 1.Identification of the agency, contracting activity, and specific identification of the document as a justification for other than full and open competition. The U.S. Department of Veterans Affairs, Contracting Office at Providence VAMC, proposes to enter into a contract on a basis of other than full and open competition for Research Consulting Services in fulfillment of the referenced requirement of the Research and Education (152) Service. 2.The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc. Contracting Action: A new, sole source, labor hour, Research Services contract with Shana L. Klinger, MA. 3.A description of the supplies or services required to meet the agency's needs. The requirement is to provide consulting services for the VA protocol "VA Study to Optimize the DEKA Arm" at Providence VAMC at a total cost of $69,600. This project is a Service Directed Research Project sponsored by the VA Rehabilitation Research and Development (RR&D) Service. This contract requires that Ms. Klinger continue to serve as a consulting Qualitative Data Analyst on the project. 4.The statutory authority permitting other than full and open competition. The statutory authority permitting other than full and open competition is 41 U.S.C.253(c)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1entitled, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements." 5.A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority. The specifications of the work and the requisite skills needed to successfully accomplish the goals of the contract are of such a nature that few individuals possess them. Shana Klinger, MA is uniquely qualified to provide these services to Dr. Linda Resnik (Study PI) at the Providence VAMC based upon the following: a.She has been working on the DEKA Arm project since March of 2009 (via contracts with Ocean State Research Institute and the VA). b.She has familiarity of prior iterations of the DEKA Arm. c.She has familiarity with the technological and usability issues associated with the DEKA Arm, which is prerequisite knowledge to perform the data analysis. d.She has co-authored publications with Dr. Resnik related to the field of devices and prosthetics. e.She is experienced in the use of the qualitative software (NVIVO) used for this project. f.She has over 10 years of experience in the field of qualitative data analysis. g.She has over 15 years of writing experience and the ability to make technical concepts understandable to a wide range of readers. 6.A description of efforts to ensure that offers were solicited from as many potential sources as is practicable. Include whether or not a FedBizOps announcement was made and what response, if any, was received, or include the exception under FAR 5.202 if not synopsizing. Describe whether any additional or similar requirements are anticipated in the future (this may not be included as an addendum, but must be in the body of the JOFOC). The acquisition will be synopsized to FedBizOps, the Government Point of Entry. (GPE). 7.The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable. The Contracting Officer determines that the anticipated price(s) will be fair and reasonable based on the following: The proposed rate is competitive with the rate for experienced research/healthcare data analysts. As a burdened rate (inclusive of General and Administrative (G&A) and indirect costs) the hourly rate of $65/hour is comparable to rates in the Boston Statistical Metropolitan Area (SMA) for a comparable data analyst in the 0101 Social Science Analyst Series. The contract comprises a base and two (2) one-year option periods with a total value of $208,800.00 8.A description of the market research conducted and the results. The hourly rate determined is competitive with Ms. Klinger's contracted rates with the Commonwealth Fund and the State of RI Department of Health. At the time that the initial contract with Ms. Klinger was initiated, we also conducted an informal survey of colleagues at Brown University who utilized external analysts in their research projects to determine whether the proposed rate was in keeping with the market. Based based on this information we believed that the rate was reasonable and appropriate. 9.Any other facts supporting the use of other than full and open competition. The work to be performed as part of this contract is not suitable for full and open competition because Dr. Resnik, as the responsible Principal Investigator, needs to be confident that the contractor is capable of the qualitative analysis of the therapeutic measures involved in this study. In addition, the project is under a strict time constraint, limited by a contract involving DARPA. The requirements cannot be modified to enhance competition, as they are determined as a result of an IRB approved protocol and are in line with the project as approved by VA Central Office Rehabilitation Research and Development Program Officer (Robert Jaeger, PhD). 10.A listing of any sources that expressed a written interest in the acquisition. None. 11.A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated. VA Rehabilitation Research and Development (RR&D) Service and the Principal Investigator continue to monitor requirements and developments in the market for these services.
