- DETERMINATION OF LIMITATION OF SOURCES VA Pacific Island Health Care System 459 Patterson Road Honolulu, HI 96819 1. Contracting Activity: Department of Veterans Affairs, Consolidated Contracting Activity-VISN 21. 2. Description of Action: This action limits competition for the acquisition of renting outdoor hotel spaces of the Hale Koa Hotel in Honolulu to provide recreation activities in conjunction with the National Veterans Golden Age Games (NVGAG) to be conducted from May 25 to Jun 1, 2011 for VA Pacific Island Health Care System (VAPIHCS). 3. Description of Services/Supplies: A request for services was placed by Karl Hall, Associate Director of Honolulu VAMC on 4 Feb 2011. The Honolulu VAMC is identified as the host of the 2011 NVGAG from May 24 to Jun 1, 2011. During this period the host is planning numerous outdoor functions and activities for the NVGAG participants to be conducted at the only viable, large open space, adjacent to the contracted hotel facility that can accommodate wheelchair bound participants. The contracted hotel, Hawaiian Village, is unable to accommodate over 1,000 participants in an open space environment, whereas, the Hale Koa Hotel is ideal and secured. The value is $63,100.00 for renting the outdoor grounds from May 25 to Jun 1, 2011. 4. Authority Cited: FAR.13.601(b)(1) Only one source is reasonably available because the Hale Koa hotel is ideally located next to the contracted hotel and have outdoor recreation space that can accommodate approximately 1,000 users. The ideal location has wheelchair access to the grounds and will be used for numerous NVGAG events such as shot put and discus throwing. No other location will meet the Government's needs for outdoor space that is adjacent to the contracted hotel. 5. Reason for Authority Cited: The authority cited in paragraph 4 must be used because of the bona fide Government requirement that necessitated this commitment via 2237 459-11-2-3371-0024. Customer comments associated with this purchase order "There is no other field or other open area for rent in Waikiki that could accommodate this group. This site is located next door to the host hotel and the veterans are elderly and some are physically challenged; using wheelchairs need the site to be accessible to where they are lodged." 6. Efforts Made for Soliciting from Other Vendors: a. This requirement will not be synopsized in accordance with 5.202(a)(2), in that this acquisition is being conducted under unusual and compelling urgency and the Government would be seriously injured if the agency complies with the time periods specified in 5.203. b. This requirement does not allow for competition due to services rendered. 7. Fair and Reasonable Cost Determination: The Contracting Officer has determined that the anticipated price will be determined to be fair and reasonable. A Price Negotiation Memorandum (PNM) will detail how the Government has determined that the anticipated costs will be fair and reasonable. As this service has been determined to be commercial, cost or pricing data will not be required. Pricing techniques such as are described in FAR 15.404-1(b)(2), will be used to establish price fairness and reasonableness. 8. Market Research: Because of the urgency of this action, market research was not conducted. 9. Supporting Facts: Any supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government's minimum needs or requirements or other rationale for limited sources) and which form a basis for the justification have been certified as complete and accurate by the technical or requirements personnel. The evidence for this is the "Technical Data to Support a Restricted Competition" in the contract file. The NVGAG is the premier senior adaptive rehabilitation program in the United States, and is the only national multi-event sports and recreational seniors' competition program designed to improve the quality of life for all older veterans, including those with a wide range of abilities and disabilities. The Games serve as qualifying event for competition in the National Senior Games in a number of competitive events. Military veterans ages 55 and older who receive health care at any VA medical facility are eligible to compete in the National Veterans Golden Age Games. The Hale Koa hotel site has the most suitable open outdoor space that is accessible for wheelchair bound participants, large enough to host over 1,000 people to attend day and evening events, and suitable to conduct numerous NVGAG athletic events, recreational and rehabilitative events (i.e. shot put, discus throwing, Opening Ceremony) and competitions (Horse shoes and Adaptive Track and Field Events). The Hale Koa grounds provide ample space for all participants and spectators. The Hale Koa, which is less than 100 yards from the contracted hotel, is the only hotel suitable to meet the Government's needs. 10. Listing of Sources: Hale Koa Hotel, 2055 Kalia Road, Honolulu, HI 96815, 808-955-0555. 11. Statement of Actions: This is a statement of actions to avoid unauthorized commitments for emergency services. Because this type of event is considered a "one-time" only event, it is imperative that all parties concerned are involved in the early stages of planning to preclude the use of "urgent and compelling" procurements. a. Notify the Director of NVGAG that when planning to host an event of this nature to ensure all requirements are planned prior to securing the contracted hotel. b. Notify the Host of the event to perform market research to determine if there are suitable hotels and outdoor spaces available to host such an enormous event for the NVGAG veterans with special needs. c. Notify the Transportation Coordinator to be part of the planning stages to ensure suitable hotels and adjacent outdoor facilities are suitable for the NVGAG. 12.
