Description
This Brand Name Justification is published for information only. This requirement is being competed under GSA E-Buy. CONTRACTING OFFICER'S STATEMENT REGARDING BRAND NAME JUSTIFICATION Oracle License Technical Upgrades and Maintenance 1. Identification of Agency and the Contracting Activity: US Forest Service, WO-CIO 2. Nature and/or Description of Action Being Approved: Brand Name Justification approval is hereby requested for annual maintenance and technical upgrades for existing, perpetual Oracle software licenses required to support the FS information technology infrastructure. 3. Description of Supplies or Services Required to Meet Agency's Need Including Estimated the Value: a. The contractor shall provide the government technical upgrades and maintenance of the software licenses identified in Attachment A - USDA FS Licenses - Oracle dated 18 January 2011. b. The contractor shall provide Oracle Premier Support, as follows: • Major product and technology releases • Technical support • My Oracle Support • Updates, fixes, security alerts, data fixes, and critical patch updates • Tax, legal, and regulatory updates • Upgrade scripts • Certification with most new third-party products/versions • Certification with most new Oracle products 4. Identification of the Justification Rationale (see 8.405-6(a) and (b)) and, if applicable, demonstration of the proposed contractor's unique qualifications to provide the required supply and service: Oracle is a leading supplier of database software products on the market in the United States. The procurement of perpetual Oracle software licenses and associated support for Information Technology solutions has been an ongoing relationship since the FS Server architecture migrated from a main frame to a distributed IP architecture as part of Project-615. As a result of this corporate decision, the Agency invested in perpetual and periodically renewable software licenses from Oracle and implemented the software across the IT infrastructure. This procurement provides for maintenance and support of both types of licenses as well as the renewal of non- perpetual licenses. Procuring Oracle brand name support for Oracle licenses offers the following advantages to the agency: a) Leverage existing investment: The agency has already invested in the purchase of the perpetual Oracle licenses identified in Attachment A. In order to effectively use the perpetual licenses in the FS environment, the FS has an ongoing need to upgrade the licenses and obtain Oracle support of said licenses when necessary. By procuring the maintenance and technical upgrades to existing licenses owned by the FS, the FS can effectively leverage the existing software investment in which the information technology environment and infrastructure is built around b) Reduce integration costs and time to market: FS support technicians will be able to use familiar programming software for initial installation and updates. This is critical to maintain continuity of services in existence today. c) Reduce support costs: Agency technicians have had extensive agency/vendor training to support Oracle software. d) Provide priority service: Due to the long-standing relationship with Oracle, the agency would be provided priority service with a dedicated account manager working through the prime contractor to support FS purchases and provide support. e) Other product specific advantages: This product allows the FS to take advantage of our extensive work force that is trained to support Oracle software and its integration into the agency's infrastructure. 5. Determination by the Ordering Activity Contracting Officer that the Order Represents the Best Value Consistent with 8.404(d): Competition under the GSA Schedule will be used to procure the Oracle technical support and upgrades. 6. A Description of Market Research Conducted Among Schedule Holders and the Results or a Statement of the Reason Market Research Was Not Conducted: Market research was conducted and a determination was made that Oracle technical and maintenance support can be procured direct from Oracle or through authorized Oracle resellers. On 03 March 2011 the CO made a check of contractors with GSA contracts who could supply Oracle products to update the previous market research performed by the program manager. Nineteen (19) contractors were found; 15 SB and 11 LB. Of those 11 SB and 3 LB contractors had the two (2) SIN codes required for this effort. On this basis, the CO determined that full and open competition offered the best opportunity to maximize competition and assure the Forest Service of being able to acquire the needed Oracle support. 7. Any Other Facts Supporting the Justification: None 8. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome Any Barriers That Led to the Restricted Consideration Before Any Subsequent Acquisition for the Supplies or Services is Made: The Oracle maintenance and technical support order will be written for a base and four (4) option periods. At that time, the market can be reevaluated to determine whether or not there is another source for the Oracle maintenance and technical support. 9.
