- ***The National Institute of Standards and Technology (NIST) awarded a Purchase Order dated 22 March 2011, via a limited competition basis, under authority of FAR 6.302-2 Unusual and Compelling Urgency, to Eckert & Zeigler Analytics, Inc., 1380 Seaboard Industrial BLVD, Atlanta, GA 30318, for the purchase of radioactive materials. Limited competition determination was based on the potential for severe financial harm to several Government agencies due to a potential for a significant delay of a testing campaign which will utilize the radioactive materials. NIST has entered into an interagency agreement with the Department of Homeland Security as a part of a Test and Evaluation Campaign of certain instruments. Other agencies are also involved in this campaign. These sources/radioactive materials are being used for calibration, characterization and verification of radiation detection systems performance as well as part of a proficiency test to assess laboratories' testing capabilities. The radiation detection systems will also be tested against ANSI standards N42.35 and N42.38. If the radioactive materials are not received, by April 12, 2011, there will be financial harm in the amount of approximately $1.0M for rescheduling. This financial harm will effect the Department of Homeland Security and other agencies to a lesser extent. 6.302-2 Unusual and Compelling Urgency (a) Authority. (1) Citations: 10 U.S.C 2304(c)(2). (2) When the agency's need for the supplies or services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals, full and open competition need not be provided for. (b) Application. This authority applies in those situations where (1) An unusual and compelling urgency precludes full and open competitions, and (2) Delay in award of a contract would results in serious injury, financial or other, to the Government. (c) Limitations. (1) Contracts awarded using this authority shall be supported by the written justifications and approvals described in 6.303 and 6.304. These justifications may be made and approved after contract award when preparation and approval prior to award would unreasonably delay the acquisition. (2) This statutory authority requires that agencies shall request offers from as many potential sources as is practicable under the circumstances. NIST received the request from Department of Homeland Security in November of 2010; however, it took NIST several months of extensive market research to locate the required uncalibrated radioactive materials. As the lead time for these materials is approximately 2-4 weeks from date of order and the planned testing was to begin in April of 2011, there was not sufficient time to process this order under the regulations governing this type of procurement.
