- SUBJECT LINE: NOTICE OF INTENT TO NEGOTIATE A SOLE SOURCE CONTRACT WITH AMERICAN SCIENCE & ENGINEERING (AS&E) FOR PURCHASE OF 2 GEMINI X-RAY INSPECTION SYSTEMS The U.S. Nuclear Regulatory Commission (NRC) intends to negotiate on a sole source basis with American Science & Engineering (AS&E) for the purchase of 2 Gemini x-ray inspection systems. The statutory authority permitting other than full and open competition is 41 U.S.C. 253(c)(1), as implemented by FAR 6.302-1, which provides for limiting competition in those situations where only one responsible source and no other supplies or services will satisfy agency requirements. The AS&E Gemini x-ray inspection system, with the Z Backscatter technology, is the agency standard used throughout the NRC Headquarters and satellite office buildings. The Z Backscatter system and technology is only manufactured by, purchased from and maintained by AS&E. It is important that NRC is consistent with the x-ray inspection system due to the movement of the security guard force from post to post as well as the movement of mailroom personnel who all need to be trained on these machines. With the procurement of these Gemini X-Ray machines, the NRC will remain consistent with the established standard as the organization expands. The North American Industry Classification System (NAICS) code is 334517. This notice of intent is neither a request for proposal nor a solicitation of offers. A determination not to compete this proposed procurement based on responses to the notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. In doing so, interested sources must submit technical capabilities and any other information that demonstrates their ability to meet the NRC's needs. Detailed capabilities must be submitted electronically to valerie.whipple@nrc.gov no later than 5:00 p.m. EST on April 20, 2011. Telephonic responses and response providing insufficient information for evaluation by the NRC will not be considered.
