Description
The Naval Air Systems Command, Naval Air Warfare Center, Weapons Division (NAWCWD), China Lake, CA, intends to enter into negotiations for a Firm Fixed Price order GM02 under an existing Basic Ordering Agreement (BOA) N00019-10-G-0001, with Thales Avionics SA of France. The requirement is for an upgrade to the Optimized Top Owl (OTO) Helmet Mounted Sight Display (HMSD) System Operational Flight Program (OFP) and system interface for the UH-1Y and AH-1Z System Configuration Set (SCS) 7.0. This development will include OTO HMSD preliminary and final software builds. The delivery date will be June 2012. The Thales' HMSD system was qualified on the UH-1Y and AH-1Z airframe as part of the platform's state-of-the-art weapon acquisition and engagement system under the H-1 Upgrades Engineering and Manufacturing Development (EMD). During EMD, the aircraft's avionics suite was designed to incorporate and accommodate the Thales helmet system. Following EMD the UH-1Y and AH-1Z platforms are undergoing continuous improvements in an overlapping Spiral Upgrade Program which includes upgrades to the HMSD. Thales is currently developing software to incorporate SCS 6.0 upgrades and they are the only source who can execute the SCS 7.0 upgrades and thereby maintain compatibility with SCS 6.0 implementation. This requirement will be procured in accordance with the statutory authority permitting other than full and open competition under 10 U.S.C. 2304(c)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1(a)(2), in that Thales Avionics is the sole designer, developer, and manufacturer of the OTO Helmet. Thales Avionics is the only known company with the knowledge and capability to provide the required development and updates for this system. See Notes 22 and 26. All responsible sources believing that they can provide the required service may submit a capability statement, proposal, or quotation clearly showing their ability to perform the work without compromising the quality, accuracy, reliability and delivery of the product which shall be considered by the agency. All submissions must reference BOA N00019-10-G-0001 GM02 and be received at the contracting office no later than 06 May 2011. Award of this order is expected to be on or about October 2011. Note 22 - The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302. Interested persons may identify their interest and capability to respond to the requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within forty-five days (thirty days if award is issued under an existing basic ordering agreement) after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Note 26 - Based upon market research, the Government is not using the policies contained in Part 12, Acquisition of Commercial Items, in its solicitation for the described supplies or services. However, interested persons may identify to the contracting officer their interest and capability to satisfy the Government's requirement with a commercial item within 15 days of this notice.
