Description
The Division of Contracts, Office of Administration, U.S. Nuclear Regulatory Commission (NRC) intends to negotiate and award a short-term, sole-source bridge contract with L-3 Communications Government Services, Inc., for IT infrastructure services and support. On February 18, 2011, the NRC competitively awarded a contract for Information Technology Infrastructure and Support Services (ITISS) to Perot Systems Government Services, Inc., as a result of Solicitation No. RFP-33-11-325. A protest of that contract award was filed with the Government Accountability Office (GAO) on March 9, 2011. In accordance with the Competition in Contracting Act of 1984 (CICA), performance of that new contract has been stayed pending resolution of the protest. Presently, information technology infrastructure services are being provided by the incumbent contractor, L-3, under the NRC's Infrastructure Services and Support Contract (ISSC), which expires on June 27, 2011. The NRC requires uninterrupted service until after the GAO protest is resolved and for a reasonable period of time thereafter to transition to the new contract. Therefore, the NRC anticipates negotiating and awarding a short-term "bridge" contract with L-3 to continue the services throughout the new transition period. The bridge contract is anticipated to include a base period of four (4) months and one (1) two-month option to extend the term of the contract if that should become necessary. The bridge contract may also include the clause at Federal Acquisition Regulation (FAR) 52.237-3, Continuity of Services. The proposed bridge contract will require L-3 to provide planning, staffing, supervision, management, and leased IT hardware and software resources necessary to ensure the effective and efficient support, administration and control of the leased IT infrastructure and desktop computers, as well as operating maintaining, and upgrading the NRC Distributed Computing Environment. The statutory authority permitting other than full and open competition for this acquisition is 41 U.S.C. 253(c)(1), as implemented by FAR 6.302-1, which provides for limiting competition in those situations where only one responsible source and no other supplies or services will satisfy agency requirements. No source other than the incumbent can satisfy this short-term need given the transition period that would be required, and conducting a competitive acquisition for this short-term need would result in unacceptable delays in fulfilling the agency's requirements and substantial duplication of cost to the Government that is not expected to be recovered through competition. The following Section 508 Standards will apply to this new short-term contract with L-3: (1) Subpart B -- Technical Standards: 1194.21 Software applications and operating systems, 1194.22 Web-based intranet and internet information and applications.16 rules, 1194.25 Self contained, closed products, 1194.26 Desktop and portable computers; (2) Subpart C -- Functional Performance Criteria: 1194.31 Functional performance criteria; and (3) Subpart D -- Information, Documentation, and Support: 1194.41 Information, Documentation, and Support.
